having a argument on another site about wtd!!!
my argument was that anytime you spend on break is not counted as working time regardless of its length.
I.E. if i took 10 mins break although its not a break for wtd regulations to reset your time its still not classed as working time.
the other guy recons its classed as other work if its less than 15 mins, i maintain that is incorrect.
I would love to have your views on this.
You’re right, although a break of less than 15 minutes doesn’t count as a break for regulation 7 of the RT(WT)R it’s still a break, regulation 5 makes clear that breaks rests and periods of availability shall not be included in the calculation of working time.
