A one-eyed refuse lorry driver who ran over a colleague in an incident that led to his death today walked out of court with a suspended prison sentence.

William Seago obtained a light goods vehicle licence to drive the 26-tonne truck that crushed to death his friend and work colleague Keith Warman only because he cheated in an eye test.

The 52-year-old of Orchard Road at Paulton, was told his act of deception had been “calculated, irresponsible and dishonest” as he was handed a six-month prison sentence, suspended for 18 months.

Seago, who admitted charges of careless driving and making a false statement, was also ordered to carry out 150 hours of unpaid work and his driving licence was endorsed with nine points.

He will ask the DVLA himself to restrict his driving licence to smaller class B and class BE vehicles.

The court heard that Seago suffered regular flashbacks to the tragedy.

A judge at Bristol Crown Court heard that Seago had been collecting rubbish in Adams Close at Peasedown St John on April 11 last year with 55-year-old Mr Warman from Radstock, and a second colleague, Roger Baker, when the accident happened.

Simon Burns, prosecuting, said no one had seen how Mr Warman came to get knocked down as the Mercedes lorry travelled at no more than 6mph in the cul-de-sac.

He had previously told the court that Mr Warman had been at the front of the vehicle near the pavement and Mr Baker at the rear when the defendant was manoeuvring the lorry and appeared not to have seen his colleague in front of the cab.

The court heard that it had not been clear what direction Mr Warman had been walking from when he went under the front nearside wheel and his skull was fractured.

Mr Burns told the court that the defendant had been blind since birth in his right eye, but had been found to have good peripheral vision in his left eye and experts concluded that his monocular vision had not contributed to the tragedy.

However the court heard that the defendant’s condition automatically barred him from driving class C LGV vehicles such as the Mercedes.

He obtained his licence by cheating in an eye test, memorising the last two lines of an alphabet board and failing to declare that he only had sight in one eye.

George Threlfall, defending, said his client could not get the death of his friend out of his mind.

"It’s with him on a daily basis. He has flashbacks. He can’t forgive himself for what happened.

“It has impinged on his life and marriage of some years standing.”

He said Seago had passed the practical LGV test and driven for four-and-a-half years without incident but said the former bin lorry driver who now works in a cheese factory had conceded his licence should be reduced so that he can drive only smaller vehicles.

Mr Threlfall said his client had been examined by a nurse after his eye test, who then passed him on to a doctor but neither had noticed that he could not see in one eye even though he has no pupil.

He said the hospital concerned had either destroyed or lost the records.

Sentencing Seago, Judge Neil Ford QC told him a moment of inattention at the wheel had had tragic consequences.

"The vehicles which you were driving are large and require a driver to be able to see with both eyes to ensure manoeuvring a vehicle can be carried out safely.

"Your motivation for obtaining the licence was in my judgement to obtain work and better paid work you might otherwise have been unable to obtain.

"Your act of deception was calculated, irresponsible and dishonest and I must punish you accordingly.

“The prosecution accept the court was dealing with a moment of inattention which had tragic consequences. Your criminal culpability in relation to the death was minimal.”

Having read the article, it did say that the drivers vision was most likely not the cause of the accident. Anybody who has driven dustcarts will know that the Loaders generally have no idea of what they should and should not do around a lorry, especially one that is manoeuvring.

They will try to put bins on the back whilst a driver is reversing around a tight corner and squeezing the vehicle between parked cars, they will lurk in blind spots and all sorts of stupidity. They do not seem to appreciate that a driver has a lot more to look out for than just them,

To me this seems to have been a very tragic accident, but the deception practiced by the driver has compounded the tragedy. The waste services industry is now officially the most dangerous occupation in the UK, and being a dustman is said to be one of the most dangerous jobs in the country.

It is made worse, in my experience, by the fact that all too many employers in the waste services sector do not give their employee’s sufficent training and even worse, new agency staff get none at all, they learn on the job! That in itself is a scandal and it is little wonder that tragedies occur and will continue to occur.

Having done a few weeks as a refuse driver on the agency, all I can say is that reversing a bin wagon is like trying to drive a truck through a box of squirrels, backwards using an out of focus black and white tv. The loaders have absolutlely no concern for their own safety and will happily step out behind you while you are trying to reverse up a narrow lane with both mirrors folded flat by the bushes.

Its a great job in reality but you really do earn your money by not killing them, maybe two eyes is really what is needed :smiley:

No i’m not hijacking it, yes i’m bad and no it shouldn’t be a new topic. So, whats your take on it?

It should never have happened thats my take on it.

He was crushed inbeetween the learning truck and a parked trailer …

If you want more info look at all the wrong info given by the papers. ( nothing new there )

I believe The coroners Verdict was accidental Death .

Apparantly he was training in a 7.5Tonner ( Typical Papers )

No one stands outside whllst doing the Controlled stop let alone in front of the truck …

Since this the company concerned has published and gave out to all their instructors company proceedures to my knowledge this is the first time they have ever given out thier instructors any form of company training proceedures
