NIP and the union

Hi guys. I’ve just received a NIP for allegedly doing 37 in a 30. Work have checked my (analogue) tacho and it shows under 30. The tracker on my truck shows I was doing 27 at the time. Does anyone know if this is something the union would take up for me or will I be on my own.

If you’re paid up I don’t see why not but I’d imagine they must see a fair few of these.

You should get a free half hour with a lawyer but try to get one who specialises in road traffic law.

I would imagine that your tacho and your company tracker should hold some weight with them.

Tacho won’t show where you were at the time, but the tracker will.

Can you speak to union lawyer on a phone appt., or get a shop steward to take it up on your behalf?

I’d definitely fight it, you have two independent forms of proof, they have one which may not even have been working correctly…

How accurate are vehicle trackers? ours is apparently 8 minutes behind where you actually are and there is quite a bit of tolerance on time on a tachos accuracy.

Doesn’t matter if it’s 8 minutes behind. Live tracking doesn’t come into it in this case. Just ask the office to play the route back when you get back to base, what speed was I doing at such and such a place and time.

Tacho’s are never exactly 100% as we know, but if it’s matching up with the tracker in this case, only bolsters OP’s defence in the matter.

I’d definitely consider checking the current validity of the speed cameras calibration.

Re playing back. I’m outbased so don’t go to the yard but they said they’d send the evidence to me so I can contest it.

Most likely a fixed camera, if it was a police stop they would have pulled the card and checked it.
OP, camera marker number will tell you exactly where you were…

+1 most of the live trackers are pretty ■■■■ accurate, probably better than the camera, I’d have thought that the Union should contest this, as soon as the authorities see your evidence they’ll drop it like a stone, don’t want you in court proving how inaccurate the cameras has been, would get in the papers then every other person done by that camera that day will contest it :wink:

Yeah. Found that out when I spoke to them. But unfortunately I don’t have driver care. Got some advice of them about what to do next though.
