I am doing night work working 12am till 8.30am, I understand the max hours I can work nights is 10hours. Is that for wtd? Does that mean I can only work 12am till 10am max? Thanks [emoji2]
The Road Transport Working Time Regulations impose a limit of 10 hours WORK in a 24 hour period on any driver or mobile worker who works between the hours of 00:00 and 04:00.
This limit is 10 hours of WORK - not 10 hours of DUTY. Therefore any BREAKS or POAs recorded are not included in the 10 hour restriction making it possible to be ON DITY for 15 Hours yet carry out less than 10 Hours of WORK.
Of course a driver can choose to opt out of this restriction, but must do so in writing by way of a workforce agreement which can then be valid for 5 years.
So if you want to work more than 10 hours when the work is available - sign and agreement and the operator will keep it on file. Chances are you may have already signed one.
