As above does this start at 00.00 and finish at 23.59 so if i have worked from 7pm untill 5am i have used 5 hours of the next day say if i start at say 4 pm i would have to be finished by 9pm forget about breaks poa and collective agreements thanks

No the 24 hour period does not start at 00:00 and finish at 23:59, for the night time working limit the 24 hour period starts at the start of the shift and ends 24 hours later.
If you start at 19:00 the 24 hour period ends at 19:00 on the next day.
Suppose you start at 19:00 Monday and finish the shift at 05:00 Tuesday and have had a 45 minute break, you don’t start the next shift until 19:00 Tuesday when you will start a new 24 hour period so you’ve done 9 1/4 hours working time in that 24 hour period.
However if in the previous example you were to start work at 18:00 Tuesday and work through 19:00 you would have completed 10 1/4 hours working time in the 24 hour period from the start of shift on Monday, so you would not have complied with the working time regulations unless there was an opt out agreement in place.
