Night out in a day cab

is what one of our guy’s was facing Wednesday night, after the M1 was closed due to an accident. however, the TM desperately needed the lorry back (rigid 18 or 20 tonner),as it was going back out that night,so he ordered an underling manager to send the pool car out to replace the driver,as he was over his 15 hours. the replacement driver took over the rigid, and the guy over his hours drove the pool car back. this is wrong surely? it’s all kicked off with the underling being blamed

Yes it’s illegal when it’s his 15 hrs expired. Would have been ok if it was his 10 hrs drive time expired.
No need to blame the underling, it’s all on the driver.
If 2 shifts use the same truck, why are they exceeding 12 hours? How long did the closure delay him?

cheers stu…don’t think he relished a night out in that motor…and he’s our Driver Rep!

Over hours = nearest safe place with accommodation if in a day cab
