Need help got pulled in car 2 bald tyre mot just ran out

I was in the garage having a chat to a fellow trucker and went to leave, I looked over my shoulder and noticed a blue unmarked Audi with a bobby in it he saw me I then got in my car. I went to drive off and and he pulled in front and pulled me over in the garage (private property) he said you have no mot. The mot ran out 3 days prior he the progressed to the tyres he found they was bald just a little on the edge. I said sorry I don’t usually drive this car as it is in my mrs name. He understood then took my details did some checks and told me I would get a letter I said will I get a fine he said you might he said he would inform the dvla. He then took pictures of the tyres on his phone but said I could drive it home but don’t crash. It was on a garage forcourt but had been there for some time before I got in. I know this is not truck related but I’m craping it now cos I think I’m getting 6 points and fines.

Any advice please

I think the tyres need at least 1.6mm depth for at least 3/4 of the tyre width from the centre and go the full circumference of the tyre. A little balding on the edge? I don’t know if that would involve you getting done.

If he had stopped me on private land and before I’d got on a public highway I’d have left the motor there but that’s no good to you now.

One glimmer of good news is that you’ll only get 3 points for two tyre offences committed on the same occasion.

But why did the copper let you on your way in the car knowing it was not legal ?

Depends what you said at the ‘scene’. As you were on your way to an MOT test… How bad are the tyres? Got any pictures of them?

Your looking at a ban if this is real… 3 points, per tyre, no MOT invailidates your insurenece, 6 points total of 12 = TT99 on your licence
Say good bye to your driving job for 4 years, after your ban.

You have not MOT so you have no insurance, he would have had a traffic unit there ASAP or helt you up till one was available, as they are the only coppers with the power to seize cars.

Doesn’t matter if its private or not, if the general public has access to it, eg Tesco car parks, the RTA etc etc still applies.

If you crashed, and this copper “logged this stop” with his control, he’s just opened him up for a good roasting back at HQ.

EDIT, Did you ask to see any ID, did you take down his collar tag?

Nope not MOT means no insurance and therefore also no tax, so yes six points easily if it is true.

That is a solicitor’s advertisement and it is misleading and wrong.

Section 28(4) of the Road Traffic Offenders Act 1988:

Where a person is convicted (whether on the same occasion or not) of two or more offences committed on the same occasion and involving obligatory endorsement, the total number of penalty points to be attributed to them is the number or highest number that would be attributed on a conviction of one of them (so that if the convictions are on different occasions the number of penalty points to be attributed to the offences on the later occasion or occasions shall be restricted accordingly).

Depends on the insurance company. IF it hasn’t been involved in an accident as in this case, then it is ‘usually’ a fine/ fixed penalty and as long as an mot is attained within the time frame of any fixed penalty notice, then it doesn’t invalidate your insurance, so it’s down to company policy really.

I got stopped for speeding 10yrs ago so I got 3 points, had no mot at the time but copper said in not a fine so was not fussed. I think most insurance policies says a car must be road worthy. E.g a 10 month old mot doesn’t mean the car is road worthy currently. So no mot doesn’t mean no insurance.

A little balding on the outer edges wouldn’t cause a problem I wouldn’t have thought, as others have mention it applies to the 3/4 of the centre of the tyre. Assuming no cords are showing of course.

If I was him I would be more concerned about the fact is that he is letting his wife drive around in a possibly dangerous/illegal vehicle. I will drive any old shed but I always make ■■■■ sure my wife’s’ car is always top notch.
And that story still sounds made up …

Again that is an advertisement, and again it is wrong. Driving a car with an expired MOT does not invalidate insurance. Even being eight times over the drink drive limit does not invalidate insurance.

Thanks for the positive answers some are a bit aggressive. chill, were not all perfect and it was her old car she has a new one and I had to use this one to get something done and mot ran out 3 days.

I’ve just noticed that the ticket with the no mot has not got a CCCJS code also the writing is very scruffy the mot one has. The CCCJS code is the code for cps so I think I’m getting done on the mot but not the tyres ffs I hope.
