im a bit late with this,
killed last saturday on the A1 at cockburns path,
It was a headon with another wagon,
He was ex -para who went on the driving ,soon to be a qualified lawyer,
He had a determanation in life that he could acheive ,
what he worked for education he went back to college to acheive the results to be accepted for law school. after he left the army.
He told me about the time he dropped his trailer to go an see his parents ,
he went back in the morning to see the trailer up to its knees in tarmac, no luck mate .
to his wife daughter and parents.
he was a rare guy ,
glad i worked with him.
one more tour is what he wanted.(but we knew that)

It has been 3 weeks now and we are gradually beginning to get things sorted. Iain qualified and graduated as a lawyer last year and was due to return to Edinburgh University to do his Masters degree. He always joked he had more letters after his name than me!
Can anyone tell me if agency drivers needed to have their own personal insurance to drive and if there is a limit on their hours they can work per week? Do companies who employ the agency have their own insurance for Death in Service. I am thinking for the future of his 4 year old daughter, do you think it’s worth pursuing this avenue? Regards Ali

Hi AliA Welcome to Trucknet, although it’s a welcome tinged by such tragic circumstances, your Brother sounded like somebody who made the most out of life.
I’ll try and be as much help as I can.
Not to sure about the Agency queston, but I think you’d have to prove the company negligent to get any money out of them, unless they had some sort of life insurance policy for thier employees.
He would be under the same regulations as driver employed by a company, That is Drivers hours Regulations and Working Time directive.
Doing other non-driving work would also affect the hours he’d be allowed to drive.
You really need to get some proper legal advice really on the company law, but if you have any specific questions about drivers hours and other haulage related stuff that will help you, somebody on this site will have the answer.
Sorry to hear of your brothers passing.
As an agency driver, he would have been like any other contractor in any business, and have been responsible for his own insurances for life and the like. Agency drivers, however they get their work, are self employed contractors, unless he was on paye with the agency, then he would have been like an ordinary employee. You will need to speak to his agency and ask what his status was.
Muckles is correct on the drivers hours laws though.

Now that a family member has posted , things change. I therefore now offer my- -albeit belated- -Very Sincere Condolences to the family of the late Ian Boyle.
To Scania245, so obviously affected by the loss of a work colleague, for whom he had justifiable Great Respect. I offer my Sympathy also. I have met and lost , in varying circumstances, people like Ian Boyle in my lifetime. I know how it feels.
With regard the questions put by Alia. muckles and Quinny have given sound advice with regard to the legalities of being an Agency Worker.
I am assuming that, as yet no inquest into the cause of Ian Boyle,s death will have taken place. Inquests take into account all the details of what led up to this tragedy.From which the Coroner will draw conclusions.
The Coroner will then issue a verdict ,which may or may not apportion blame for the cause(s) .of the event which took place. My advice to Alia now is this. In the first instance , contact your nearest Citizen,s Advice Bureau. You will there be given a free half hour with a Lawyer. That lawyer is qualified to spell out the Legal aspects of Employment Law, as they apply to Agency Workers.

1 of my friends/workmates was first on the scene of this accident, he said it was horrific, was Ian the driver of the iceland vehicle?
Hi Everyone, thanks for your posts. I really appreciate having contact with everyone at the moment. Iain was the driver of the Iceland Lorry, the Police said it was a bad one and Iain died on impact. The inquest may take 6-8 weeks yet to know what happened. We are aware that Iain had massive multiple injuries and along with my parents we saw him the next day. My Dad contacted Iceland directly to ask how and why agency drivers are insured when they pass on the contract. I didn’t know that the contracts are subbed out and subbed out again…all new for me. It won’t bring him back, but he had just graduated and driving at night to make ends meet & pay the rent. a few personal items were never recovered, but I guess that the wreckage was pretty bad and that’s why. Thanks again for taking an interest, if anyone knows anything else about the accident on the 10th July, we would like to know. Alison

as far as i know ian worked under an umbrella company /self employed,
more in the pay packet but no frills.
i know about the life insurance he had .
As for the hours hed worked he was legal.
just a tradgedy.
