Here is the situation.
Night working - getting the truck ready for a delivery and collections run. You help out offload and load and do a second run.
Typical driving time is one hour going and one hour back but the delays involved in finding people, making sure your load is secure and explaining to people on both ends paperwork requirements and what is supposed to go where or for whom hack.
Client expects a third run from you but supervisor says he needs truck in two hours instead of three.
You haven’t had a break and 7 hours have gone by but you try to hide this by setting your tacho to look like you have had at least 15minutes somewhere.
What are the rules regarding multi dropping where driving is occasional or infrequent?
Are they the same as normal EU rules where for every 4 hours you must have a 15 minute minimum break and one hour after 6 hours continuous?
There are two sets of rules that determine when a break is needed.
Firstly the EU DRIVER REGS - breaks determined by driving time only
AND
Secondly the RT(WTD)R regs - breaks determined by total work (Driving and Other Work) time
Breaks count for each set of regs but remember that a split tacho break is a 15 then a 30
In your case it seems that the RT(WTD)R is more likely to be the first set of regs that you will need to conform to -
SIMPLE VERSION FROM HERE:
Don’t work (Driving and Other Work) for more than 6 hours without at least a 15 minute break, that’s any period of 6 hours.
If your shift has between 6 and 9 hours total work (Driving and Other Work) you need at least 30 minutes of break(s) and if over 9 hours you need at least 45 minutes of break(s), all break(s) completed before the end of the shift.
If you start work between 00:00 and 04:00 don’t work (Driving and Other Work) more than 10 hours unless your company has an opt out of this limit.
Don’t work (Driving and Other Work) more than 60 hours in any week and average no more than 48 hours per week over the company reference period.
