Moving truck without digi card in?

hi guys could you please give me summit black and white back on moving a truck without a digi card in, driver i know takes his card out at night when were overnight, then before his 9 hours rest period is up he will move the truck somtimes up to half a mile without his card in , im sick of telling him he cant do that as he is breaking into his 9 hrs rest period but to no avail he says its LEGAL , please give me summit back on this so i can show him cause im sick of telling him , he’s one of those ‘’ dont try to tell your dad how to ■■■■ eggs ‘’ kinda guy , thank you in advance.

Our shunters have to put their card in to move our rigids 200 yards, It takes longer to put the card in and take it out than it does to shift the truck. As we now have 10 rigids this is literally a waste of time!
Just one question- why does your mate need to move before he puts his card in? Surely he’s not that desperate to get cracking!

oh aye , to load then to sit about for 2 hrs , its beyond me and the other drivers ? i think if he ever gets a tug he;s in for the high jump !

Don`t think the shunters LEGALLY have to put in the card to shunt.Maybe a company rule,but surely not a legal one for shunters?

I don’t know off-hand where you will find it in black and white that you cannot move the vehicle in your daily rest period, but I would have thought that common sense would tell your colleague that it can’t be legal.

The result of getting caught is a prohibition notice TE160DH which I assume would mean being parked up for the 11/9 hours daily rest period, and a fixed penalty of £60.

REGULATION (EC) No 561/2006 Article 4 (f) ‘rest’ means any uninterrupted period during which a driver may freely dispose of his time;

Moving the vehicle means it is no longer an uninterrupted period and therefore no longer ‘rest’.

Leave the ■■■■■■■■ to get on with it. If the Vostapo give him a tug he’ll have some explaining to do.

I can’t understand why, when I was shunting I would be shuffling the same 40 trucks around all night, from one end of the warehouse to the other, pulling them off the bays to get a trailer on and then replacing it when the trunks had left. It was in the first days of the tachograph, but it still stands for me
