Moving a vehicle when on rest

Hello everyone

We are Exelby Services Limited and we own services/truck stops at the Golden Fleece, Carlisle, Whitwood, Castleford etc

What is the law regarding asking a driver to move his vehicle when on a break/rest?
We often have incidents where a vehicle will be parked and obstructing access (often not the drivers fault i must add!). Is a driver allowed to move his vehicle if we need access eg to fuel delivery point?

Any guidance will be greatly appreciated

Drivers are allowed to interrupt their break or rest period to move a vehicle in an emergency or when instructed to do so by a competent authority, however I very much doubt that this would apply in your case, it’s up-to you or your staff to see that no required access points are obstructed before the vehicles park.

If they’re in a 13 plate or newer, they’ve more than likely got the newer Tachograph Unit & you can move for no more than 30 seconds, then put it back on break, this will not affect the break, as long as they press the Bed Mode within 30 seconds of moving it.
If it’s an older Taco it will record the movement, so they will have to start their break again (or at least have another 30 minutes, if they’ve already had over 15)
Just offer them Free Bacon Rolls & I’m sure they won’t mind. Lol.

which is why its always good to take the card out

Why don’t you paint Yellow Hatchings around the areas you need kept clear. Most drivers should be able to ‘Understand’ what they are for. (Although there will always be One !) lol.

a. there is always one who ignore all signs etc
b. sometimes we allow a wagon to park in an area overnight as long as they move by say 8am. eg at Castleford we have an area for the pallet services during the day but overnight he doesn’t need it, so as we are often short of spaces we allow wagons to park there. Unfortunately this request gets ‘lost in translation’

If its that important that the area is keep clear then stop putting profit in the way of what you want to happen …
No Parking means NO PARKING … if you park something where you’ll need access later and the drivers taken ill over night or breaks down (flat battery) who’s fault is it …YOURS …

How’s that going to work and still meet this requirement for a daily rest period taken in a vehicle?

When a daily rest is taken, this may be taken in a vehicle, as long as it has suitable sleeping facilities and is stationary.

Drivers parking on fuel pumps and or routes through area genuine pain in the arse and should lose their licences for dong so.

Look at Markham Moor, nobody uses the truck stop, they all park in the Shell garage on the opposite side causing a nuisance to the night drivers who wish to stop and eat at Mc Donald’s. Many a time I’ve had to drive through because there is nowhere to park for 5 minutes due to all the cheapskates who block off the through road.

The only option that’s left is to ask the driver to split his daily rest 3 h and 9h. How are you going to convince the driver is another issue.

Hi I know this isn’t about rest but can you pleaae ask the Parker at Castleford to keep space near the gas tank as I have trouble sometimes getting near to fuel up

I would think the chances of them wanting the vehicle moved just when the driver has had 3 hours rest is a bit remote, and if he’s already done a shift of 12 hours or more it’s a none starter anyway :wink:
