Moved on by Police

Hi all, earlier tonight I was told to move by the police or face a fine for causing an obstruction.

I was on daily rest since 17:30, moved on at 19:10, I was looking to start at 04:00 tomorrow, question I was wondering is if I had done a printout and asked the officer to sign stateing he had ordered me to move on, would I still have been able to start at 04:00? As now I’ve moved I’ve obviously restarted my daily rest?

Did it cause you to go over your 15 hours or your 9/10 hours driving time? If not there would be no reason for him to sign anything.

I had ten mins left of a 9 and half hour left of 15 so was okay in that respect, I’ll just take it on the chin as I’ve only lost about 20 mins start in the morning, just miffed as it was the first time I’d parked there on advise from a good friend :blush:

Yeah, no reason for him to sign anything as you could legally move. You’re on a night out so not much time required for vehicle checks in the morning, up, couple of minutes and crack on. Minimal damage to your plans.

From Guidance note 3 - 561/2006

In other places (e.g. at parking places, at border crossings and in cases of emergency), if there are objective emergency reasons for which the vehicle must be moved or if the police or another authority (e.g.: fireman, road administration authorities, customs officer, etc.) give an order to move a vehicle, the driver must interrupt his/her break or rest for a few minutes and in that case should not be prosecuted. If such a necessity arises Member States enforcers must grant some tolerance following an individual situation assessment. Such an interruption of a driver’s rest or break must be recorded manually by the driver and should, if possible, be authenticated by the competent authority that ordered the driver to move the vehicle.
