Anyway, it’s not an issue. DVSA and the Traffic Commissioner seek out habitual offenders who kick the arse out of the rules, not some poor sap fresh out of training school who has messed up a manual entry.
I was only done for 1 time of mins without a card in , never been done before so I’m not convinced it’s only the ones who do it regularly who will get done .
Nb I know from speaking to the compliance officer they dvsa we’re not convinced it was a one off & did regular checks over 18 months but never found anything , but it still went to court
At the end of the day it’s all about ££££££ , and I doubt the dvsa solicitor cares whether it’s 1 offence / 10 , he’s more interested in his £400 fee for a few mins in court x 2/3/10 driversTbf doze wtf possessed you to remove your card,…at what point did you think it was the best option.
It’s blatant falsification of records mate, one off or not.
Basically you are saying you were tucked up in your bunk, but in reality you were still working/driving and not recording it, ie an act of fraud that they take a very dim view of …so you left them zero choice to make an example of you.Lads have done time ffs for similar offences,.and if you had had a ■■■■ up situation hitting some car or whatever,you sure as hell would be also mate I reckon,.so maybe a lucky escape eh?
Banged to rights I reckon mate, if you had driven over your time with an explanation, it would have been a non event…but I reckon you realise that one now.
A lot went on that day rob , ( it’s all listed somewhere on here ) so not going through it all , I lost my head which is par for the course for me , but the judge said the company has a duty of care to you & failed dismally that day , when everyone was on about a visit to t/c , lisense suspension the tc gave a caution , so I believe she / he understood my frustration that day , the company were going to sack me / instant dismissal , make your own way home from Carlisle , but after talking to me in morning( if I could of got home that night id of left lorry at toothill , my mates spent most of the night chatting , trying to calm me down , that’s when you realise you’ve got good mates ) with hr present they were just shaking there heads at what had happened , just get in your lorry & carry on with your work , I lost it , everyone is different , I’m just not your calm thoughtful person , I’ve not changed in 62 yrs so I doubt it will in the future , id of not got done for taking my card out if the planner / manager had bern present , though gbh would of been a possibility , I was long gone rob , just couldn’t think straight , spent most of that night walking round Dagenham yard
Then 15/20 yrs vosa never showed any interest in me they stop me the next day , 6 of us in convoy , foreigners & they stop me , unreal , I can’t believe they did , but you’d think they’d seen me take out card
It’s life rob , we’re all different , react in different ways , life I guess

If that’s all true doze then sounds like you were stitched up by someone, can’t remember who it was you worked for at the time (stobarts?), But hard to believe they pull you & ignore the foreigners. You sure your mates are really mates

It’s all well documented on here , I don’t know what to think to this day , the vosa bloke who pulled me in was talking to other vosa bloke as if he was telling him something , but you can think all sorts can’t you , I had a a- frame on with concrete & they were looking at straps etc , so maybe that’s why they pulled me , he even said it one stage you’ll be gone in 2 mins mate
I took my card out at Dagenham , and was stopped Carlisle so I can’t really see they knew , I’m guessing more likely was there enough straps etc on load
It’s life , my point was I’d not think because it’s 1 misdemeanour you’ll be ok , every one told me a few mins without a card once you won’t get done , I did , there not going to turn down £££££££ or £776 in my case even though they did all seem a bit sympathetic to why I did what I did ( it did actually cost me 2 k + as I had to have 2 weeks unpaid as whenever lisense came for renewal it was sent by dvsa to t/c office .
