Hi folks ill not bore you with the details but The DVLA have misinformed me twice now(phoned again today)on filling out my D47PU form and have returned the application to me(not been delivered back to me yet)
My licence expires 25/9/2024 and ive a medical now booked for this Friday the 6th so fingers crossed ill have my new licence returned to me by then but if not can someone tell me how a section 88 works is it something i need to download im going on the assumption that i will have no medical issues to report on D4 form and no other change of circumstances and i should also make it clear i work for a agency and the company they send me to photocopies my licence every shift i start.
Im at a loss.
Ps Im not waiting on the return of my D47PU form ill be sending back a new D2 and D4 form a new application.
To use Section 88 properly to ensure you’re covered, you need to: retain copies of your licence application and medical form, be told by a doctor that there are no reasons you cannot drive (preferably in writing so you can prove this) and send your application by recorded delivery, then check (online) after a few days that it has been received.
I don’t understand why you would have sent off the application without a medical when it appears you know that a medical was needed.
I know you have posted in another thread and you said your C+E entitlement runs for another couple of years.
You seem to now believe a medical is due, who told you this?
It is very difficult to assess the situation without knowing all the details, such as the letter you received, the form you filled in, exactly how you filled it in and what you provided with the form. Also what it says on your current card.

My experience of sending off a valid medical was that I had my licence in my hand a few days later. In my case I just sent off my old licence card because typically I don’t need to produce it very often.

The DVLA staff member said i do not need a medical to keep my HGV licence July27 because i was happy to let my bus licence expire Sep24 when i phoned 3 weeks back.
Sent off D47PU only to get it returned saying i need to fill out a medical D4 form phoned again and told the same no you don’t need a medical, post the form back explaining why.
I phoned today for a update to be told it will be sent back to me again because i need to fill out a D4 form and this was me talking to someone in the medical side.
He mentioned something about me turning 50 and to be honest im exhausted with them.
Ive got a medical booked for this Friday il will take in a new D2 and D4 form and post them off which obviously means i keep both bus/lorry for next 5 years but the delay is now getting me close to having a out of date licence hence the section 88 question.
In theory if you filled in the correct boxes it should have been okay.
There can of course be a discrepancy between bus and lorry for a few different reasons. A set of forms will be sent out for the bus if the expiry is before for whatever reason.
The complication seems to be the photo part because otherwise I don’t see a reason why you couldn’t just take no action and be absolutely fine to continue driving.
Im at a loss the last time i sent back the form i returned it with a note i couldn’t have been more clear about what i wanted and yes form was filled out correctly.
God knows what will happen now when i return the D2 snd D4 forms knowing my luck it will just delay the process even longer because they will have started my application with a D47PU form.
Im hoping this will be the end of it 3rd time lucky.

Theyll probably return my card with 5 years worth of Class D entitlement but the same July27 on my C&E.
One medical can cover both yes.
What I don’t know is if you have entitlement left on the HGV, whether you can have a medical with 2 years left to set it back to 5 years.
Just out of interest, what is the date for licence expiry on the front of your card?
Licence expires 25 September so does my entitlement for buses.
CE entitlement runs until July 27.
Obviously i sat my medical before turning 45 when i was still driving buses and i then done another medical before doing my hgv training i past my test July 2022.
I get the feeling they don’t know what they are doing at The DVLA so im just going to start afresh send in D2 and D4 and pray they don’t find another issue.
Im freaked out now because of the time scale.
It is kind of annoying though because it was only the photo required.
Yes i reply on form to renew both my bus/hgv and they then send back form again saying my hgv entitlement is not up for renewal i should have just marked box for Class D.
It may be that they always look out for a D4 with that renewal form. Maybe you would have had more luck with a D2, impossible to know.
Personally I would try sending a D2 saying that you are renewing the photo and nothing else. First class recorded and you may have your licence in a week.
Maybe true im going to phone one last time tomorrow morning to see if i do need tge medical.
On The D2 form the question is Section 1c I want to renew or surrender.

My licence WITH the following entitlement or
My licence without the following entitlement (surrender)
Both questions have boxes for lorry bus.
Well i suppose ill be ticking both boxes for WITH entitlement because i suppose i am renewing my licence and i do want it renewed with hgv entitlement even though yes theres still almost 3 years to run on it.
As i said one more call tomorrow and im going to ask for a supervisor/manager this time.
I have one here that might be quite old, but you can definitely send away just to update the photo and you don’t even need to fill in the eyesight / hearing / health questions.
And ive asked this before ill ask again is the medical every 5 years from turning 45 ie 45 50 55 and so on or is it every 5 years from when you sit you’re first medical ie 48 53 58 etc?
After you turn 45, you need a medical the next time your entitlement expires.
It isn’t necessarily 5 years after you sit your first medical because I think if you are obtaining HGV category for the first time (either C or straight to C+E, they give you a full five year licence after passing).
The expiry date of your licence is on the front of it, where it says “4b” . Assuming you are approaching or over 45, when that date passes you will have needed to have renewed your licence with a D4 medical.
I have been following the case and it seems that in this case the 4b date does not coincide with the end of the entitlement for C+E. This was due to bus entitlement expiring and also apparently a photograph being required.
I’m pleased someone can follow it, OP has me far more confused as to his needs than I prefer to be
