my company has 3 depots , the tax is applied for online and then recived and sent down too maldon from manchester , therefore im driving at the mo with tax expiry from end of april , if the disc does not arrive this week coming although its been proceesed can i be prosecuted for failure too display

have a valid DLA404 if you’re entitled to disability exemption
You can renew your tax any day from the fifth day of the month.If you prefer to tax in the last few days of the month, there is now an exemption from the offence of not displaying a tax disc. This exemption covers the first five working days of the month and allows time for the new disc to arrive in the post.
The exemption only applies if applications are made before the current tax disc or SORN expires.

i didn’t even know about a 5 working days exception, learn something new everyday
But since there has already been 5 working days in this month , that’s me going with monday-friday being working days then you cant drive it on monday unless there is a new disc.

Monday was a bank holiday, and as such, not classed as a working day, so, you can drive the truck on monday, but not after

A change in the law comes into effect from 1 September 2008.
From this date, there will be an exemption from the offence in Section 33 of the Vehicle Excise and Registration Act 1994 (VERA) of not displaying a valid tax disc. This will apply for the first five working days at the beginning of the month in which the tax disc commences.
It will be legal for motorists to drive or keep their vehicle on a public road without a current tax disc, for the first five working days of any month. This exemption from displaying a tax disc applies only when an application for a new disc has been made before the previous one has expired.
Motorists are advised to display the expired tax disc, however, they will be committing an offence if they continue to use or keep the vehicle on a public road without a current valid tax disc after the first five days of the month.
In the mists of time, around 1978, I was stopped going in a westerly direction on Dodworth Road, Barnsley by two plod in a Ford ■■■■■■. I was eventually summoned to court for failing to display a valid tax disc and having no operators licence. At the time I was buying a house and was in regular contact with a local solicitor. I showed him the summons and he wrote me a letter quoting chapter and verse about the law.
Basically as an employed driver I could not be fined for either offence as I was not the “USER” or “Registered Keeper”
Is this still the case?
I got a pull on the A75, and the tax disc was 5 months out. The policeman showed me it and my reply was ****, he just said here is a £60 fine for your boss. So i assume its the same the employer is liable for it.
The vehicle was taxed but no one had gotten round to putting it on the truck !
No wasnt my normal truck was a one off using it typically and i get pulled.
