this is something i have spoken to employer about several times and he swears blind that I can sit as passenger. However I thought would get to the bottom of it and just spoke to VOSA and NO you are not allowed to sit as passenger dont matter if in a car or in truck as it is classed as other work!!!

What you do when you finish work is nobody’s business but yours. If I had a government official ask me how I got to work I would fail “the attitude test” without a doubt.

It’s like dealing with officials anywhere, you have to know where to draw the line or they will mug you off all day.

i wouldn’t lose any sleep over the fact that you got driven back home, illegal or not!! as some one else pointed out likelyhood of ever getting picked up on it is very slim, if you just write an explaination on your card or print out ran out of time due to traffic ect, so long as mr vosa man see that you know you did wrong they normally don’t say a word, its when you try to hide things they get upset :unamused: :unamused: :unamused: :unamused:

You are both missing the point.

He started at midnight, ran out of hours at 3pm, then had to wait till 5pm for a car to pick him up, drive him back to the yard which he arrived at 6 or 7 pm I’m guessing by the time waiting for the car to arrive, then drive home, probably to start work at midnight again, and even if not, be extremely tired for driving his car home.

I’d have probably done it though, as others have said, better to be home sometimes, but the OP clearly didn’t want to, so legally he could have told them to ■■■■ off

the driver started at midnight, and finished at 3pm.
the other driver couldn’t get to him until 5pm.
the truck could have been moved, and on its way to be tipped at midnight quite legally.
i can’t see what the urgency is at that time of day.
and another thing. you would have been in breach of the WTD regulations, as you had worked between midnight and 4am.

If agreed by the collective work force you can ‘opt’ out of the night working 10 hours work ruling Phil

And the 10hr working rule is just that, a 10 hr WORK rule, breaks and POA don’t count, so duty time can still be 15hrs :unamused:

There’s nowt to add up Phil. Nothing was said by me about tipping at midnite. The trailer had to be on Immingham docks by 9pm to be put on the 10pm boat.

The company i used to work for had several depots around the uk, To save on running costs they would tell us to park the trucks up at their SE depot, and they would run us back up north in a van (should of been a minibus) then we would drive home from our local depot, and then after our weekly rest we would do the reverse sometimes having to drive a van to the SE depot,
We did have it out with the boss who’s get out attitude was check your contracts, you will see that you don’t as such work from one single depot, He then asked if we wanted to use our own vehicles instead of his, “to make it legal” :unamused: :laughing:

If any one had of refused to do it his way, they would have been starved of work, As that companies attitude towards its drivers was if you don’t like it ,you know where the door is, and drivers are two a penny to find

If you’re being given a lift home in your own time (having booked off when you popped your digicard out) then I can’t see why you’re not legal - problem is, this is obviously wide open to abuse from employers who’ll have you running to and from a remote depot/vehicle in your own unpaid time on a regular basis… :unamused:

i just pictured an old boss that jumped up and down over [zb] all. the job was completed legally, but he couldn’t add up.
i figured it could have been a similar senario.

It’s legal if after your daily/weekly rest period you’re going back to pick up the vehicle from where you left it, in a scenario like that travelling home and back is disposing of your rest time as you wish, if you’re travelling back to base or home so the company can have the vehicle back you’re clearly acting on the instructions of your employer and that’s other work not rest :wink:

Article 9 - (EC) 561/2006

In Article 9 - (EC) 561/2006 is:
Any time spent travelling to a location to take charge of a
vehicle falling within the scope of this Regulation, or to return
from that location, when the vehicle is neither at the driver’s
home nor at the employer’s operational centre where the
driver is normally based, shall not be counted as a rest or
break unless the driver is on a ferry or train and has access to a
bunk or couchette.

The law on travelling to or from a location other than a drivers usual place of work to take charge of a vehicle has been tested in court in 1999, Skills Motor Coaches Ltd and 3 of their drivers were -after a decision by the European courts- prosecuted in Nottingham Magistrates Court for not recording on a tachograph chart the time travelling to take charge of coaches that were not at the employees usual workplace.
