My boss wishes to change the working pattern of the drivers from 5 days out of 7 to 6 days out of 8, is this legal
Yes.
Although by about week 10 there is so good chance you will need an extra day off to meet the weekly rest requirements of a weekly rest period for each fixed week.

Will it be 6 on 2 off or 6 out of 8?
6 out of 8 could be something like 6 on 2 off 3 on 1 off 3 on 1 off 6 on 2 off 4 on 1 off 2 on 1 off 6 on 2 off etc
Its 6 days on then 2 days off, works out that I’ll be working an extra 15 days per year, bummer

for how much extra than if you did 5 on 2 off so your doing 15 days at what rate?? if you don’t mind me asking
I’ll be getting nothing extra for the 15 days

Good time to negotiate a pay rise I’d say surely the drivers wouldn’t put up with that.

+1
I think the boss’s idea is that as long as our hours average out at 48 a week he shouldn’t have to increase our salaries and as there are only half a dozen drivers he feels we can be replaced by agency. I should also point out that as we only deliver our own product they dont need an O licence so therefore no transport manager. This means the drivers are more knowledgable about whats legal than the person making all the decisions

I thought a restricted O licence was needed with a CPC person ■■

So do your hours work out 48 with just work and driving without the use of poa and required tacho / wtd breaks ?
if not whats the true figure with everything ?

And don’t forget it’s going to be a 6 day week sometimes so you’ll have to do some short days, and as Nick said have your bare 45 mins break everyday and no more so those hours stay up.
On the O licence front they may have a restricted one but dont you just apply for them, there’s no course or training required. As far as the hours are concerned some of our drivers are doing 50 hour weeks on a 5 day week so it’s going to be interesting, we dont do POA. I think whats going to happen is that we will all start to drag it out a bit so that the 6th day would put us over 60 hours.
Thank you all for your input, it was most useful
