Yes, it’s fine.

And with the extremely long rest period at the end you have already compensated, before the latest it should be done by, for the one reduced daily rest that required it, the one on Thursday/Friday of week 2, so you can crack on with no worries.

He’s had a regular weekly rest period in week 1, a reduced weekly rest period in week 2 and a regular weekly rest period in week 3, and as far as I can see never gone over the 144 hours between weekly rest periods.

You haven’t, ROG frequently gets stuff wrong, he doesn’t actually use the tacho rules see. You are fine with everything detailed above.

That is the problem with premod - I realised that I had missed the 90 hours off being 2 x 45 but the edit function is taken away so could not change it

We all make little errors but unlike others on here who can change something when an error is made I do not have that option

Err, no, where did I say that? As I said, comment away, I only read about half the replies to things I post anyway.

I’ve been discussing this with a friend and they are of the opinion that:

The weekly rest on Thurs 4th - needs to be paid back. ie. 21 hours to be paid back by the end of the 3rd week following the week in question

And the same with Thurs 18th.

So I am of the opinion that, if I have already shown a 45 hour weekly rest in week one, then the 24 hour weekly rest is only to stop me working more than 6x24hour periods and does not need compensating,

But my friend says ANY weekly rest period must be paid back, even if two are shown within the same ministry week.

Any thoughts?

You did 90 hours off at the start of week 1 so that counts asa full 45 weekly rest for that week
that makes thu 4 as an extra weekly rest which counts for no week at all so does not need paying back

at the end of week 3 you had 111 hours so the first 45 of those is the weekly rest counted for week 3
That makes the weekly rest on thu 18 an extra weekly rest which does not count for any week so again does not need paying back

Only reduced weekly rests which COUNT as the weekly rest for a particular week need compansating

Your friend is wrong and you are right, you’ve had full weekly rest period in weeks 1 and 3 and a reduced weekly rest period in week 2 and that’s all that’s legally required, the reduced daily rest periods in weeks 1 and 3 only serve the legal purpose of allowing you to start another six 24 hour periods.

It’s simple.

The regulations require one weekly rest period per week and any rest periods over and above that are pretty much surplus to requirements.

In a week:

One full weekly rest period - No compensation.

One reduced - Compensation required.

One full and one reduced - No compensation.

Two reduced - Compensation required for one, your choice.

I remember a multi page thread on this very subject a while back. I was pretty much a lone voice saying the extra rest periods did not require compensation but finally ROG, Tachograph and others saw the light, especially when ‘VOSA’ chipped in and confirmed it. :wink: :stuck_out_tongue: :stuck_out_tongue:

I seem to remember that was not me saying that but I was trying to say that the time used for the extra weekly rest could be used for two different purposes which was incorrect :blush:
