Is this legal to take out?

Looks like trailers been run with suspension lowered and tyre has rubbed through the rear mudgaurd on a tri-axle.
TM says a repair is booked for tomorrow and ok to use tonight.

Is this on or can/should I refuse to take it out?

There’s no sharp or jagged edges which could catch somebody passing and I’m assuming the rest of the spray suppression is intact. I’d take it out - I’d mark it in your defect sheet as an advisory.
