Is this false advertising?

Raymond Baxter told me that by the year 2000 no one would drive cars but would travel by jet packs on our back!

There would be no more trucks as everything would be delivered by levitation. They even tried to demonstrate it

I believed him

Could I sue for that?

SimonB:
The Institute of Logistics do say there is a driver shortage:

CILT(UK) > Pages

They state that by 2010 there will be an HGV driver shortage of ‘60-80,000’

The article is predicting the shortage for next year - and we’re not there yet (its still 2009 guys) - so no one is lying. It is a fact put out by the Chartered Institute of Logistics & Transport.

What is the problem with this?

Si

IMHO, that’s a fair point SimonB, but the problem could be the way in which some people use ‘facts.’

When an honest person makes a statement, it’s usually made with the caveat that it is in the light of current knowledge and invention. That way, if it should turn out that it becomes wrong/incorrect because of a newer fact coming to light at a later date, the original statement cannot then be said to have been deliberately misleading.

I’m not suggesting for a moment that the CILT would set out to mislead, but let’s be fair, that statement was given out in 2003, so here are two key questions: #1.) Back in 2003, who knew in advance that the “credit crunch” would be here at present?? … and #2.) Did the CILT know that the info might be used so far into the future and possibly by somebody doing so without permission??

Problems arise when organisations knowingly use out of date ‘facts’ to over-egg a situation in a misleading way. Of course, it may be that this has happened accidently, but sometimes there appears to be a pattern to it. Given that it might not be coincidental, let’s just say that some folks aren’t as daft as some other folks think they are.

IMHO, I can’t see any harm in ROG phoning somebody to ask them an honest and open question, then checking with the alleged author to see whether they did indeed say what it is said they said. In fairness to all concerned, maybe the people on whose website the info appears might have forgotten to ask the original author’s permission for them to use that material. If an honest enquiry by ROG serves to remind somebody that their website needs, shall we say ‘updating,’ then surely that’s a good thing for all concerned?

UPDATE -

I called the Advertising Standards Authority (ASA) who passed me onto Trading Standards.

Trading Standards are most interested and are now looking at the 5 websites I posted on page 1 of this thread.

Probably be a long while before another update as these things take time…

They just don’t give up :imp: :imp:
