Hi. Been an occasional HGV driver over the years and never really come close to any Tachograph Hours limits. It’s obviously a very complicated area. Can anyone tell me whether the following pattern of driving is allowed?
Day 1: 14.25hrs Daily Rest-4.5hrs Driving-45min break-4.5hrs Driving.
Day2: 3hrs Daily Rest-4.5hrs Driving-45min break-4.5hrs Driving-14.25 hrs Daily Rest.
If it is ‘legal’, does it matter where the ‘days’ begin, or is it just “periods of 24hrs”?
Thanks in advance.
Andy
Unsure how to read your post …
Could you do something like this please - for me coz I am simple
Daily REST 11 hours
Shift 12 hours
Daily REST 10 hours
shift 13 hours
Driving time and BREAKS seem ok

It’s not really possible to say whether that’s legal or not.
You need to put your start and finish times so we can see how much daily rest you’ve actually had.
A new period of 24 hour starts when you’ve completed a daily rest period (start of the shift), the daily rest period must be completed within the period of 24 hours from the start of the shift.
Thanks for the replies.
Sorry, I’ll explain further.
Say:-
Day1
00.00 start 14 hrs Daily Rest
14.00 start 4.5 hrs Driving
18.30 start 60 min break (to keep it simple–only 45mins needed)
19.30 start 4.5 hrs Driving
Day2
00.00 start 3hrs Daily Break
03.00 start 4.5hrs Driving
07.30 start 60 min break (to keep it simple–only 45mins needed)
8.30 start 4.5hrs Driving
13.00 finish
Cheers

From 1400 day 1 until 1300 day 2 you have done 18 hrs driving and had 5 hrs rest. That is illegal in so many ways.

For some reason you keep starting each day at 0000 - that is not how the regs work
Each shift/duty time starts at the end of a daily or weekly rest period and it is at that point when the 24 hour clock starts
If you end a rest period at say 0600 then do 10 hours on duty followed by starting the next rest period at 1600 for 11 hours then starting the next duty at 0300 the previous 24 hour period stops and a new one begins at 0300 even though the old 24 hour period has only got to 21 hours
There must be at least a 9 hour rest period between duty shifts which is allowed a max of 3 times between two weekly rests - the normal daily rest period is 11 hours
From the end of one rest period to the start of the next rest period is the 24 hour period the regs refer to and all the duty time and rest time must fit inside that 24 hour period
13 duty then 11 rest = 24 hours so ok
15 duty then 9 rest = ok BUT counts as one of the allowed reduced 3 between weekly rests
14 duty then 11 rest is only 10 rest for the regs because 14 + 11 = 25
Does that help

07.30 start 60 min break (to keep it simple–only 45mins needed)
8.30 start 4.5hrs Driving
13.00 finish
If I’m reading this correctly the shift started at 14:00 on day 1 and finished at 13:00 on day 2.
That’s a 23 hour shift with 18 hours driving.
That’s about as illegal as it gets.
I get the feeling that the OP thinks a new 24 hour clock starts every midnight therefore cleaning the sale of everything before that … just my gut feeling on this …

If that’s your regular shift pattern you’re going to need one of these …
This seems to be a question about daily rest requirements with some hypothetical examples.
The day you are referring to in the first post starts when you finish a period of daily rest, ie start a shift. The time of day or the day of the week isn’t relevant to the daily rest rules.
The requirement is to have had a daily rest - 11 hours, which can be reduced to 9 hours three times a week - within 24 hours of finishing the previous daily rest.
That’s the 24 hours in question, it’s from whatever time you start work.
You were thinking of it the wrong way round, daily rest follows the day’s work since it is counted from when you start the shift.
And it’s not the same 24 hour period each day of the week. It’s from whenever the shift starts that day.
You can start a shift less than 24 hours after the start of thr previous one provided you’ve had sufficient rest.
You can start later than the previous day and the 24 hour period starts from then, but you can’t increase your daily rest from the previous day by starting later than 24 hours, since it only counts as DR within 24 hours.

Between weekly rests not per week = I know it may seem pedantic but there is a lot of legal difference
