Is this a legal week? (NIGHTSHIFT)

Last week my nights off were Monday & Tuesday a shift was cancelled on Friday so my card wasn’t inserted, I worked Saturday night and started at 00:20 this morning and finished at 10:30am (card out).

My ‘night off’ is tonight as a reduced rest and I’m back in at 1am tomorrow morning all the way through til 1am Saturday morning.

Your night off is tonight but you’re back in at 01:00 tomorrow, sorry but that doesn’t make a lot of sense to me
Or do you mean you back in at 01:00 Tuesday morning?

I’m assuming that because you did not work Friday night you had a rest period of at-least 24 hours after finishing work on Thursday?

The way I’m reading it you started at 00:20 this morning (Sunday) and finished at 10:30, your next shift starts at 01:00 tomorrow (Monday) so not a reduced weekly rest period.

If I’ve read it correctly you need to start a new weekly rest period no later than 00:20 next Saturday (12th October), so no you cannot legally work until 01:00 next Saturday.

Sorry if I’ve misunderstood anything in your post

I’m back in Monday morning 1am

I think any misunderstanding is understandable.

@ghiabox It’s not fair to expect someone to untangle that. Try putting the hours into a grid pattern, (eg a spreadsheet) coloured for “in work” and “on rest” with the hours of the day as the columns and the shifts as the rows. That’s the simplest way to see what you’re trying to ask. See pic for an example of multiple shifts working nights - remember you need to be thinking in terms of 24 hour work periods, forget the days of the week for now.

Incidentally, are you opted out of the night work limit rule?

Yes I opted out. Sadly I don’t have time to do as you suggested as I need to go to bed, I think @tachograph is correct and my weekly rest is Saturday 12th.

OK, but that only took me five minutes while I was waiting for the kettle to boil. If you’re going to be working these types of patterns, you should keep a log of things as you’re going along through the week

Yes but remember that if your night shift started at 00:20 this morning (Sunday) then legally you must be finished work by 00:20 on Saturday 12th.

Good luck

I best tell my boss I can’t work Saturday then :joy:

Just to clarify, with my shift ending at 10:30 this morning (4 hours ago) and I’m not back in til 1am Monday (7/10/24) is today not considered a reduced rest?

No, 10:30 to 01:00 is only a 14 1/2 hour rest period.

  • A weekly rest period is a rest period of 45 hours or more.

  • A reduced weekly rest period is a rest period of 24 hours or more but less than 45 hours.

I mean a reduced daily rest of 9 hours ?

You started work at 00:20 and finished at 10:30 and am now having a 14.5 hour rest period so there’s no way it can be classed as a reduced daily rest period.

Thanks for clarifying.

You aint got time to even check, cos you need to go to bed?
Seriously ?

Look mate don’t take this the wrong way, but you sound like your stress levels are through the roof.
I aint patronising you, just trying to point something out, .
You aint got a job there, it’s a 'kin endurance excercise.:flushed:, it’s owner driver style trying to make ends meet stuff…(been there btw)

I don’t know your age, personal circumstances, or how long you have done the job, but the job does not have to be like that…the info given back to you consist of Limits…not Targets !

At best you are going to eventually fall asleep at the wheel, at worst have your first heart attack…or both!

Sorry to come across all ‘Mother Hen’, but I aint talking out of my arse here, I’ve done this a long time, and have seen MANY guys approach and do the job just like you are doing, and they just burn themselves out,.and end up looking 85 when they retire at 65.

Slow it down mate, politely tell your boss to go and ■■■■ himself and/or get a less stressful job.

Good advice, from one driver to another, sorry if it’s unwelcome, take it or leave it …or even tell me to f.off and mind my own bussiness…it’s all the same to me.
Good luck anyhoo.:grinning:

What do you mean I don’t have time to check? I never said that

As for stress, I’m not stressed I was confused is all  the boss is new in the position too so made an error which he rectified, I appreciate the concern though. Truthfully though I don’t enjoy driving trucks though, the novelty has worn off haha!

@tachograph my boss called me today and said he’d removed the Friday shift as it would conflict with my rest, thanks for your help!

Getting an early start on panto season:

Oh yes you did

I don’t have time to do as you suggested is different to ‘i don’t have time to check’ panto season indeed :stuck_out_tongue_winking_eye:

Meh… I would suggest that both @robroy and myself find your assertion to be unsupported.

Ok…but I think Zac’s actual suggestion was for you to check tbf, …but hey, it aint important.
You said you appreciate my ‘concern’ so we’ll leave it there, all good.

I’m happy with my zero induced stress job at the moment, and my layed back approach to it, and you say you are happy with yours.
So hey…everything’s cool.:sunglasses:
