I believe it is despite the tacho throwing out an over hours warning
9:00 Other Work 30 mins
9:30 Driving 2hrs
11:30 Other Work 15 mins
11:45 Rest 1hr 15 mins
13:00 Other Work 15 mins
(Tacho driving period reset to 0)
13:15 Driving 1hr 45 mins
15:00 Other Work 15 mins
15:15 Rest 30 mins
15:45 Driving 1hr 45mins
17:30 Other Work 30 mins
18:00 Driving 2hrs (tacho starts flashing after 1hr @ 19:00 “over driving hours”)
20:00 Other Work 30 mins
20:30 Daily Rest
I would be interested if this can be confirmed or otherwise.

Cheers, Nez
At 19:00 you had done 4½ hours driving since the driving time was last reset, which is why the tachograph threw up the warning.
According to what you’ve posted you did 5½ hours driving with just a 30 minute break.
But surely I’d have driven 3.75 hours with a split break of (firstly) 1.25hrs (at least 15mins) and (secondly) a further break of 30 mins. Followed by a further 3.75 hours driving before the end of the shift?

Nope, once you’ve done some driving any break of 45 minutes or more resets the driving time, if the break is 45 minutes or more it cannot be used as a split break.
When you had the 1 hour 15 minute break your driving time was reset and you started a new 4½ hour driving period, so the 30 minute break at 15:15 was the first part of a split break.
As Tacho says above what you should have done was had a 45 or hour drove for 1 or 2 min then put ur clock on break again making sure you don’t hit the 45 again that way only 15 min will count towards your next break where you would need to take a 30…
I’ve made the mistake of having a 45 then worked moved the truck but as it didn’t move much it didn’t register it what a balls up but I didn’t go over the 4.5hrs but just a pain
Thanks for the replies, I’m sure you’re correct, but could you point me to the regulation that indicates that a 45 minute (or more) break cannot be used as part of a split break?
I think I’m in for a bit of a fight with “the powers that be” in my office when I tell them they’re wrong & would like to back it up with something from the regs!
I did something similar today, I have an analogue tacho and when leaving a drop I noticed it was on break, I must have knocked it as I usually just leave it, I had no idea how long it was on break for…
I had driven about two hours that morning up to that point then needed to drive three more (Kendal and back) so took another 15mins then drove for 10 minutes and took another 30, by my reckoning that gave me the 4.5 back for the second half, I hope
I will need to examine the disc, magnifying glass out time me thinks
