Got an infringement flagged up for 14 th Sept when the battery on the unit I was driving decided it had enough, I’m not happy as its the first this year but I will fight it but what was I suppose to do when the fitter came out and put new batteries on take the card out. I mean on the print out there were no gaps or anything.

The printout won’t have gaps in it but I think it should show an event for the disruption of power, to avoid an infringement you should have done a printout and written an explanation for the event on it.

I did but obviously It’s the card that gets analysed by the outside company not the print out, when I get back later I’ll show them the print out and what I wrote at the time.

If you do a print out to explain a fault or deviation from the legislation, then the printout then becomes part of your records and must be kept safe for 12 months along with any analogue cards and the data from your digital card. This must also be analysed and acted upon as a complete record.
If you did a printout, you cannot be given an infringement, point this out as the tachograph analysis company are not doing their job. There will be an invoice or job sheet to back this up too.

Ok thanks for that I’ll see if I can get it rectified, but I never handed the printout in because I wasn’t sure that it would flag up as an infringement.

Even if you don’t it doesn’t actually matter. Getting an infringment on their system doesn’t actually mean anything, if you ever got stopped by the ministry they will do their own checks and you’ll come up clean as you did the printout. Unless there is some kind of bonus system based on it then you’re as well to just take it and let them think what they want to.

Got it overturned in the end, it was a maintenance issue not an infringement and it was some young girl in our office who misinterpreted it as an infringement so I’m all clear again.
