Insufficient rest

Advice Please…

Is my TM talking rubbish or not■■?..he tells me that if i have used up my 9hr rests for the week i cannot do a 15 hr day even if i haven’t done three as you need to follow a 15hrs day with a 9hr rest as 15 + 9 =24 so even if i toke an 11hr break following the 15hrs shift i would get an insufficient rest infringement for having to many reduced rest periods

I don’t think he knows what he’s talking about personally & he’s the one with the national CPC

You cant do a 15 hour shift and have 11 off within a 24 hour period you must have completed your rest within 24 houra of starting for it to count you can do 13 max 13 plus 11 rest =*24

Your TM is correct.

A daily rest period must be completed within the period of 24 hours from the start of the shift, if you do a 15 hour shift you can only fit a nine hour daily rest period into the 24 hour period.

Any rest outside of the 24 hour period will not count towards the daily rest period, lets say you do a shift of 15 hours then have 11 hour rest, only nine of those 11 hours fall within the 24 hour period so only nine hours will count as the daily rest period, so it’s a reduced daily rest period.

You can have three reduced daily rest periods between weekly rest periods, any shift of more than 13 hours from start to finish is a reduced daily rest period because if you work more than 13 hours you cannot fit an 11 hour rest period into the 24 hour period.

For instance a shift of 13 hours and one minute from start to finish means you’re having a reduced daily rest period, 13 hours one minute from 24 hours leaves 10 hours 55 minutes so it’s a reduced daily rest period.

edit: You need to understand that the regulations do not say you can do any 15 hour shifts, they only mention the reduced daily rest periods, any shift over 13 hours is a reduced daily rest period unless you’re having a split daily rest period or are multi-manning.

Clearly you dont. Anything over 13 hrs means you can’t have 11hrs rest in a 24 hr period, so is a reduced rest. You can only have 3 reduced rests between weekly rests. Simples

The confusion arises because people think of 15 hour shifts without realising they only exist as a by-product of a reduced daily rest period.

A normal shift can only be a maximum of 13 hours from start to finish, anything over 13 hours is a reduced daily rest period and you can only have three reduced daily rest periods between weekly rest periods.

There are split regular daily rest periods where you have a three hour rest period during the shift then a nine hour rest period at the end of the shift.

Unless you’ll manage to fit 3hrs of uninterrupted break during your shift
