Infringement for exceeding 60 hours work

Hi experts,

The other day I was handed an infringement sheet to sign for exceeding 60 hours working time in one week.

The printout stated:

49 hours work ( driving and other work)
8 hours 14 mins breaks
6 hours 6mins POA

Total : 63 hours 20 mins total

I thought poa and breaks were not counted but they are adamant that the time you start from the manual entry at start of shift right through to the manual entry entered at the end of shift ( at the start of the next shift obviously) is how many hour count against you.

Is this really correct? I pointed out that if I can legally drive for 56 hours in one week, how on earth if you do that can you possibly stay under 60 hours once you take the breaks and other work you must have to do! I thought it was possible to do over 80 hours in a week and stay legal.

  1. The times of breaks, rests and periods of availability shall not be included in the calculation of working time.

90 to be precise.

Ur company is run by clowns. Don’t feel bad, they’re all pretty much the same with a few exceptions.
