Very lucky I think. No excuse to be doing 38 in a 30, I think doing 30 over pedestrian crossings is dangerous especially when there’s someone nearby. I think it would be an open/shut case if the pedestrian had crossed on the green man, but as it was red could be taken as someone simply stepping out without looking.
I know the junction very well and can’t believe that he could be doing 38 mph it’s such a busy place there’s almost a little chicane to negotiate as well.

A stupid act by both parties. The driver shouldn’t have been speeding, and the pedestrian shouldn’t have stepped out until it was safe to do so.

I think the facts the light on the crossing was red and that he was under the limit of 30mph when the accident occurred saved him getting done

The pedestrian was guilty of nothing except failing to see the lorry; the driver should have been aware of a pedestrian on the pavement and been driving accordingly. 38mph is way too fast in a 30 limit when there are pedestrians around.

The pedestrian shouldn’t have stepped out, lorries are not exactly hard to miss. If he stepped out in front of a bike, then you could understand it.
