I may be getting the wrong end of the stick here Jase but I get a sneaking suspicion that you are experiencing a twitch or two in your “special place” at the thought of your upcoming powers to stop.

No sir, we are not doing it in the East, only the North and it is only a trial. However, I am sure if a drunk driver was constantly driving past your house at night putting people at risk including your loved ones, you’d want to do something, no you WOULD do something. DVSA in my area don’t target law abiding companies or drivers, only the slightly cagey ones. If that means stopping them falsifying Tacho records, driving illegally or using unsafe trucks putting your loved ones at risk when out and about then why not. You think a Policeman dislikes stopping people who need to be stopped?

We’re just teasing you. To be balanced DVSA may pull over the vehicles owned by companies with a few marks against them but not all the drivers are going to be unlawful if you are pulling them in. Its just checking isnt it? Or isnt it?

I worked for a company that attracted VOSA (unbeknown to me). I ran as straight as I could yet got pulled constantly. I also got pulled driving for companies with a good track record. No bother but I wouldn’t want the guy pulling me over to view me as an illegal person, driving an unsafe truck endangering little children before I’d even got to the weighbridge rubbing his hands with glee at the catch he thinks he’d netted for the bogey men. Back then the cops didn’t have that attitude when they pulled you, they were really pleasant (I got the distinct impression they didn’t like VOSA duties much)

Interestingly enough, once when I was out with the police, they pulled a foreign truck who “looked” over weight, guess what, he was empty. BUT he hadn’t had sufficient weekly rest and was escorted to the services for 45 hours. Imagine that.

Lets cut to the chase Jase (see what I did there :smiley: ) your analogy re drunk drivers does have merits, but if we step back and ask the question “why?” I reckon that it’s entirely because an underfunded, overworked and undermanned agency (DVSA) have spotted a potential huge earner in DCPC enforcement and rather than miss out on the financial gravy train have pulled strings to get you guys power to stop.

I will guarantee you two things though Jase; if it works out cheaper to give girl guides the power to stop, then you guys will be stripped of your powers pretty sharpish, also don’t kid yourselves that you’ll ever see any of the generated revenue! Aint gonna happen.

I’d nearly forgot about the merge with VOSA and DVLA, i’m pretty sure in saying that before hand VOSA had no legitimate reason to see your licence nor make you produce it. This “merge”, in actual fact just lets them access the drivers licence database in all reality.

From what I gather, DVSA will be telling us who to pull, so if we pull a ‘green light’ operator, it will be on DVSA instructions. If we don’t know our arses from our elbows that we be down to insufficient training from your colleagues. You obviously have a big problem with this trial, so can I suggest you take it up with the powers to be and not take it on the officers who are just at the bottom of the chain?

There is alot of ill feeling within the DVSA surrounding your management trying to cling on to your government status, by trying to jump in with another agency. It also comes at a sensitive time when terms and conditions are being changed. Hatos do not share the same powers as vosa/dvsa officers you are not warrented officers with the power of entry to premises, also you are not accredited to stop vehicles for the purposes of inspection. VOSA ESOs powers to stop is derive from RTA 1988 section 66A reg 2011 not the TMA 2004. The Traffic management act 2004 sect 6 powers to stop is solely for the regulation of traffic to keep the highways flowing this does not allow you to direct traffic for enforcement purposes. It is also an offence for a person to impersonate, or falsely suggest they have power of a stopping officer (RTA 1988 sect66c) or wilfully obstruct a stopping officer exercising their powers. Your highways or police status does not exempt you from this. Hatos should stick to what there where employed to do keep the roads moving, by clearing up any obstruction, after all thats the job you took on…

And remember…VOSA/DVSA have no powers to search vehicles either, so quite why fellas are letting them inside their curtainsiders to look how many straps is on is beyond me !!! Nor do they have any power to detain a driver. I say ask them how long the test will take and walk off and come back in the time they say so you can remove the vehicle from the test area !!! :smiley:

I agree,guanrantee the first thing out of DVSA mouths will be GOT YOUR DRIVER CARD ON YOU driver,if some drivers say no which I think a lot will DVSA will be rubbing their hands with glee thinking fixed penalty, then WHILE YOU ARE HERE WE MIGHT AS WELL CHECK EVERYTHING ELSE,thinking about what else they can get you for as harry enfield would say, LOADSAMONEY.
