Help with weekly rest issue

I work for an orchestra as a class 2 driver and that means my hours are never regular, I work early mornings to late at night or sometimes only half a day. My line managers don’t really know the legal side of driving regulations very well and this can lead to conflict between myself and them over rest periods, especially weekly rest periods.
Since lockdown we hardly used the lorry but now that concerts are about to start up again the problems of explaining weekly rest periods has started again. They’ve scheduled a few eight day weeks and are keen to reduce my rest as much as possible.
There are a few areas of confusion so I’d like to run a couple of weeks by you guys to get your opinion on wether I’m ok to accept their version of where my weekly rest should be taken or not?

  • Tuesday 5 October: normal shift after 45 hour weekly rest
  • Wednesday 6 October: normal shift
  • Thursday 7 October: normal shift
  • Friday 8 October: 12.00 (afternoon)start working through to 2.00am Saturday
  • Saturday 9 October: reduced weekly rest day
  • Sunday 10 October: 11.30am start to 22.00
  • Monday 11 October: 13.00 start to Midnight
  • Tuesday 12 October: 07.30 to 16.00
  • Wednesday 13 October: compensatory rest day for 9th October
  • Thursday 14 October: 9.00-19.30
  • Friday 15 October: 6.00am - 20.00
  • Saturday 16 October: 8.30- 11.00 - take a eleven hour daily rest break - return at 22.00 - 2 or 3.00 am Sunday
  • Sunday 17 October: weekly rest day
  • Monday 18 October: weekly rest day

I hope that’s clear? And that some of you can take the time to go through it and spot and glaring problems? We don’t cover a lot of miles so my driving time and breaks are never an issue.
Thanks very much.
John

One glaring error is only having 7 and a half hours rest between the end of shift on Monday 11th and starting on Tuesday 12th. Even with a reduction it can’t be any less than 9 hours

Depending what you did prior to 5 oct  then that could be the regular weekly rest for the week 4 to 10 oct
13 oct can be reduced weekly rest for the week 11 to 17 oct
17 + 18 oct can be regular weekly rest for the week 18 to 24 oct
All depends on what you did prior to 5 oct

Daily rest needs to be 9 hours between 11 and 12 oct not 7.5 hours

4th and 5th October are weekly rest for previous week.

I assume that includes sunday midnight to do that

Will you be working in the week prior to mon 5 oct  - if yes then what days would you work

if 5 + 6 is regular for previous week then …
9 is reduced for week 4 to 10
17 + 18 is regular for week 11 to 17

11 + 12 daily rest is still a serious issue

Week before:
Monday 27: off
Tuesday 28:7.30-18.00
Wednesday 29: 9.30- 18.30
Thursday 30: off
Friday 1:off
Saturday 2: 12.00 Saturday afternoon-2.00am Sunday
Sunday 3: 22 hrs rest
Monday 4: rest day

5+6 are work days of around eight hours!

Sorry got 5 + 6 wrong in previous post

Good news - I can go back to my first answer
30 + 1 is regular weekly rest for the week 27 to 3
That means 3 + 4 is regular weekly rest for the week 4 to 10

A weekly rest including sunday midnight can be at the start or end of a week but not both unless it is a very long one which can be split in two

Thank you!
I was unclear wether a compensation day taken separately constituted weekly rest.
So I just have to sort out that one short overnight rest then?

Compensation for a reduced weekly rest has to be taken in one go before the end of the third week following that reduction and is often added to a regular weekly rest

Example
reduced of 35 hours leaving 10 to be paid back
Regular of 60 hours = 45 +10 + 5 not used for anything

Can it still be taken separately attached to overnight rest?

JohnDAF:

YES
Example
Daily rest of 14 hours can be 9 + 5 payback

This has been great. I’m sure I’ll be back as new schedules get handed to me. Many thanks!

You are welcome

You can see that info leading up to a current situation is very useful for someone to give a definitive answer
