Going over 15 hrs?

frankspencer:
What’s the punishment for going over a 15hr spread? I went over by 10 mins…couldn’t find a layby, Nells cafe was full etc…stresed me right out!

You can probably expect to hear something like this…

Frank Spencer, it is my duty to pass upon you the only sentence which the law can pass for the crime of exceeding your permitted hours. The sentence of the Court upon you is that you be taken from this place to a lawful prison, and thence to a place of execution, and there you suffer death by hanging, and that your body be buried within the precincts of the prison in which you shall have been last confined before your execution; and may the Lord have mercy on your soul.

Just to play Devils Advocate, i wonder if any driver has tried to use this as a Defence…

  1. A transport undertaking shall organise the work of drivers referred to in paragraph 1 in such a way that the drivers are able to comply with Regulation (EEC) No 3821/85 and Chapter II of this Regulation. The transport undertaking shall properly instruct the driver and shall make regular checks to ensure that Regulation (EEC) No 3821/85 and Chapter II of this Regulation are complied with.

  2. A transport undertaking shall be liable for infringements committed by drivers of the undertaking, even if the infringement was committed on the territory of another Member State or a third country.

Nothing to do with me, i was just doing what i was told by my employer to do ?

Why do I wince everytime I see mention of 15hr shifts? Are there other trades, apart from the odd Dickensian chimney sweep, that work the hours we do?

Where my missus was in hospital some of the nurses did 7 am - 9 pm so running pretty close, they maybe only did it for four days a week though?

Pete.

Yes, lots, we really dont have a monopoly on long hours. Or even do the longest hours

It seems we do have the monopoly on moaning about it though.

Janos, how many hours out of a 15 hour shift do you think a nurse gets to spend lying on her back scratching her ■■■■■■■■?

I’m a ClumsyC**t…that’s why!

Whats with the nurses? Used to go out with one. They work a basic week, that can be changed through flexi-time to suit themselves, and she was on about a months holiday a year too.
I have worked too many 15hr spreadovers, whether I am in the bunk scratching my ■■■■■■■■ or not, I am still in work. It just makes me sad that I can close my front door at 0600 and it will be gone 2200 before I get home sometimes. I actually do not know anybody who regularly works those sort of hours, but I know a lot of guys on here do.
I read an article recently where a doctor said, people should not really be awake for more than 16hrs in any one day. Is it any wonder most drivers retire and die within a few years of finishing. The amount of drivers names I could reel off who have died quite young because of heart attacks is scary!!

Often drivers dying of heart attacks has less to do with long hours and a lot more to do with awful eating habits and an inability to look after themselves. As for the article with the doctor that’s just one mans opinion. Plus the whole ‘we all need 8 hours sleep’ was made up anyway. Yes sometimes we do long hours but its not the most stressful job in the world. I have friends who do similar hours in office jobs with insane amounts of pressure and stress. And they don’t get to leave it behind either like we do, phones ringing into the night. So you know, its not ideal but its hardly the worst.

So the driver shortage is just an illusion? The correlation between long hours and a bad diet is well proven, as is the lack of sleep to all aspects of our life. Fifteen hour days belong in the Victorian era. The industry is full of semi-obese, divorced, depressed and prematurely aged guys…mostly down to the ridiculous long hours culture of this job.

The driver shortage?!?!? Sorry, not sure what the rest of your post said, I was too busy laughing.

Lots of other jobs have long hours like doctors but, they don’t exist entirely on roll-ups and the output of snack vans.

If there wasn’t a build-up beforehand of formal warnings I would say you would have a valid unfair dismissal claim.
I would recommend contacting ACAS.
