being asked to do a run that cant be done in the 4.5hrs driving time , so boss saying that another driver will drive my truck for an hour with me following it in a company van , now after the hour i will get into my truck and start from there and driver who brought my truck down the road an hour will drive van back to base , im thinking that this aint right cause i will have to manually record my hours drive in the company van , boss saying no my fresh 4.5hrs will start when i take over the truck , im saying i still have used up an hour of my my 4,5hrs …i am now going round in circles with him and just want to see if i am right in what im saying , cheers

For the EU regulations the van driving is classed as other work and legally should be manually recorded as such, your driving time starts when you start driving the HGV in-scope of EU regulations.
What I don’t understand is why you don’t just use a 10 hour drive shift, if you have one available, then if you can’t get back to base in your driving time arrange to be picked up and someone else finish the journey in the lorry.
Driving the van is other work, only driving a vehicle with a tachograph counts as driving time.
So when you swap over with the other driver you will need to record a manual entry for other work for the time in the van and any other time since you started the shift.
You will then have the full daily driving limit of nine or ten hours available and be able to do 4.5 hours driving before needing a driving break.
