Fined in Spain for passenger in cab

I was giving a lift to a driver from another company from Irun to Barcelona so he could get a train. Didn’t have a card in the second man position as there was never any way he was going to drive the vehicle as not authorised to do so by the owner of the truck.

Stopped by Guardia and given € 3301 fine because apparently if someone has a truck licence and is in a truck they have to have a disc in. This is European law. Apparently.

Anyone else on here ever heard of this ■■?

If you paid then I am not sure what you can do about it (as you de facto admitted wrongdoing).
If you haven’t paid yet then appeal. As you said, he did not have the authorisation to drive the vehicle so he could not have done it (legally). As he was a lorry driver too, he should have his discs or card with him. The police could have checked his record as well as yours. Plus if you have a digi tacho then it is possible to download data from the tacho rather than from the card and use that as a support. Nobody was caught doing something illegal. The police’s argument is false (IMHO).

Thinking about it further, that argument is ridiculuos.
Imagine somebody with C-class driving licence goes for a trip with his friend/relative(C+E driver) in an artic/drawbar combo. Is that double-manning? Do they need two discs or cards? (What for? The passenger cannot drive an artic/drawbar combo).
What if they drop the trailer somewhere and go bobtail - do they need two discs/cards then?
What if the “minor guy” is not even a profi driver and thus does not have a digi tacho card?
What if somebody with E driving licence boards a bus / coach - does he have to report to the coach driver “you got to set the tacho to two men as I got a licence for this”■■? What if there’s more than one passenger with E licence? Where does the bus driver stick all those discs/cards■■?

This seems typical of the Spanish these days and I recon had either of the drivers been fluent in the local ‘lingo’ there wouldn’t have been a problem as it seems clear that the officers thought you were a ‘two man team’. Some of these stupidly heavy fines, mostly ending in ‘1’ for some Spanish reason, are simply out of touch with reality.

Mt spanish is passable and Guardia knew we weren’t two man team. Passenger only had copy of his licence with him which is not acceptable anyway.

They were adamant that if you have a licence you need to put a chart in. Was told truck is not a car or a bus , it’s only for work.

Was also told that if you were to drive with a copied licence only you would be arrested ! Absolutely ridiculous. :imp:

You still haven’t answered the question put to you - did you pay or not?

Truck had steering lock put on and documents taken.

No pay , no go, no option to go to court in near future , have to appeal against fine at later date

i’d have had a chat with his boss, who would have revolked the fine. however, if this didn’t happen, then i’d have gone to court.
they know they have you over a barrel, so just make out you have all the time in the world, all of a sudden, they havn’t got the upper hand any longer.

wasn’t it yourself with the 6k of fines at irun before xmas? sorry if i’m barking up the wrong tree, but are these posts fictitious - i can’t believe what you just posted, especially after december’s tale of woe? how the ■■■■■■■■ did the GC know the other bloke even had a licence, never mind HGV - if he didn’t have a card in then they’ve no right to even ask to see his licence :confused:

You must either be mad or have more money than sense if you rolled over and paid this fine.

It wouldn’t be parked for weeks. Did you demand to see someone higher up the food chain? That’s the first step. Did you ask to see this ‘European Law’ in writing? Of course they threaten you with parking you up etc but that is just to con you into paying. Sounds like you just rolled over and took it and every time a driver does that it just makes it easier for them to continue with this con. :unamused: :unamused: :unamused:

Naturally I questioned the fine , made him speak to his supervisor and consulted with the on duty lawyer at the fine guarantee company. All to no avail … the truck stays until the fine is dealt with.

I don’t know how much experience you have of driving in Spain but I would say from your posts that it is fairly minimal, and would respectfully suggest that you do not comment on matters that you know nothing about

I would say it is you who is the idiot for making up such stupid stories. In another thread you claimed to have been fined €4600 for having a laminated letter of authorisation. All my documents are laminated for protection and if someone claimed it was not an original I would simply cut open the laminated pouch, but this has never happened once to me as the authorities in every country (been checked in most east/west europe) that have looked at them accepted them.

Just a thought do you really drive or do you just sit at home inventing fairytales?

I think i saw a train station in irun last time i was there! If you listen to fairytales on the boat that’s your business but don’t come on here telling lies and scaremongering. Yes i do drive in spain pretty regular and your posts dont add up.
Either they are outright lies or you were doing something dodgy and this is the nonsense you came up with to try and get out of the fine.
The only law that you may have been caught under is that a double man team must have both cards in at the start of the journey, but if he wasn’t or wasn’t goint to drive then its complete nonsense and i dont beleive you.

My original question was whether anyone knew of a law saying that if you were in a truck and had a licence you needed a card in.

Consensus seems to be that no one has heard of this.

I have no need to make up stories , it’s my own truck so I have nothing to gain.

Believe it or not , there are some very big fines being imposed in Spain for trivial offences, ask Vascoingles !
