Does anybody have an example of the type of contract VOSA expect for employing an external TM CPC holder?
I’m willing to stand corrected but as far as I am aware VOSA won’t need to see a contract, the transport manager simply has to submit a TM1 form and make the statutory declarations on it. TM1 does state that a contract is required but not that they wish to see it. The requirements for the contract are as below.
External transport manager’s declaration:
I confirm that:
ï‚·
I am resident in the European Community;
ï‚·
I shall perform my tasks solely in the interests of the licence holder/applicant;
ï‚·
I shall be the transport manager for a maximum of 4 operators, with a combined maximum total fleet of 50 vehicles; and
ï‚·
I have a contract with the licence holder/applicant which specifies the tasks I must perform as transport manager. These include:
o
The making of arrangements to ensure that drivers comply with drivers’ hours and tachograph rules and with speed limits
TM1 6
o
The making of arrangements to ensure that the vehicles are maintained properly, including the inspection of vehicles at the appropriate time and the action taken to remedy defects found;
o
The reporting and recording of vehicle defects by drivers;
o
The method of compilation and the accuracy of all records, which must be kept for a period of not less than 15 months;
o
The making of arrangements to ensure that the vehicle/s are not overloaded;
o
Ensuring that authorised vehicles will be kept at the authorised operating centre(s) when not in use;
o
Where appropriate, notifying the relevant traffic commissioner (in writing) of all prosecutions and convictions concerning the operator, the drivers and me within 28 days of the court hearing;
o
Notifying the relevant traffic commissioner of my resignation; and
o
Any role that I have in:
ï‚§
Verifying contracts and documents;
ï‚§
Basic accounting;
ï‚§
Any other role in safety procedures.
Should I fail to meet any of the above requirements I understand that the traffic commissioner has the power to disqualify me from being a transport manager in any European Union country.

Just need to write something that covers all the salient points. Should be simple.

etc etc etc
and add a few details, such as the period of notice required to quit by either party then that should do the trick.

A contract doesn’t have to be a written one by law.A verbal agreement can be legal and binding. I have acted as TM for over a dozen hauliers in the last 20+ years and have never had a written contract ,or been asked to show one to Vosa.

Fair point Dave, but I’m working on a new application, so as they say there should be a contract they can see I think I should sort out a written one.

My operating centre, East Kent International Freight Terminal, is colloquially known locally as “the Sausage Factory” because owner Jim Young, who I used to work for 20 years ago, constantly used sausage factory analogies to explain every aspect of haulage and this impressed me so much that I decided for evermore to mimic his behaviour, imitation being the sincerest form of flattery

Muckles,There will be a section of your application for your TM to fill in stating how many hours and which days he intends to work them etc,also his signature will be required.I would say that is in its own right a contract.

Hi everyone,
I appreciate I’m late to the party, but I’ve recently been asked by a small coach operator to be their TM. If anyone has a copy of an External Transport manager’s contract that I could have a look at I would be extremely grateful. I think both parties will play by the book but I just want to cover my backside should they not listen to me!

Hi all, sorry to jump on the bandwagon but I’ve also been asked to provide a contract for an external TM…no idea how too/what to write. Could I aslo be cheeky and ask if someone would be about to provide me with a sample contract so I could play around with?

I now find myself in the same position as several of the previous posters. If anyone has the basics of a contract that I could use/modify to use then I would be grateful of any help.
