The exemption ticket is apparently to exempt [certain] vehicles weighing more than 3500KG from Goods Vehicle testing.
Exemption 41. Implies that a “living van” of not more than 3500KG is exempt.
It makes no sense to me.
Go with exemption 39. “Play Buses”. They’ll believe that, especially if you say it.

The main definition comes from C&U regulations but as always interpretation by different agencies is a problem, essentially another example of VOSA/DVSA not knowing their arse from their elbow.
“A ‘living van’ is “a vehicle, whether mechanically propelled or not, which is used for living accommodation by one or more persons and which is also used for the carriage of goods or burden which are not needed by such one or more persons for the purpose of their residence in the vehicle”. ‘Living vans’ are classed as goods vehicles and, depending on their weight, are therefore in either class IV or VII within the MOT test scheme or are subject to HGV plating and testing.”

The main bone of contention seems to be the carriage of motorbikes, quadbikes etc in motorhomes, many of which have large ‘garages’, and whether these are necessary for “the purpose of their residence”.
Classification as a living man would mean testing as a goods vehicle for motorhomes over 3500kg mgw and exemption from MOT for those under.
I know of someone that has converted a small Lynton exhibition trailer for living and pulls it with a Mitsubishi crewcab and the complete outfit is free of MOT requirement. I should say that the person in question has done many conversions and confers regularly with VOSA/DVSA on technical issues.
