Exceeding RTD breaks?

What are the potential (and the likely) consequences of infringing & who enforces it?

I’m thinking more of if you dont adhere to the 15min in 6hrs/ 30 min in 9hrs breaks. What would be the likely result of going over by, say, an hour occasionally?

Nothing, or if VOSA did decide to do anything the first step is advice rather than penalty.

Not sure if it is just the way I am reading it but you don’t need 30 minutes in 9 hours, unless your shift has between 6 and 9 hours of work. More than 9 hours work and it is 15 minutes before exceeding 6 hours and the next break before exceeding 12 hours or the end of your shift, whichever comes first.

Thanks for that. I normally have a 15min within 3 hrs of shift starting (also used as first part of driving break). I try to take the next break when I reach my 4.5hrs driving limit. I then have a 30min, but this is sometimes between 6 & 7 hrs after the first break finished and between 9 & 10 hrs after the shift starts.

I could rearrange it so it fits but it’s bloody inconvenient!!! If VOSA don’t take any interest then I’ll probably continue unless they have a word. The company flag it on their quarterly infringement reports, but don’t seem bothered either!!!

The shift start time isn’t relevant in calculating when the breaks are due, just the amount of work done.

Have just switched to a digi card and was wondering if someone could help me out with a few mistakes and am i likely to get chased up by VOSA

  1. I got caught in terrible traffic and went over my driving time by about 20 mins

  2. Like and idiot after finishing for the day i started the process of ejecting my card, pressed eject,confirmed the end country was uk but got sidetracked before i could confirm it wasnt a 24hour day and take my card out, therefor my card was left in there all night. As i was halfway through the process of ejecting my card would it of still classed me as working all through the night?

For both instances i got a print out and wrote on the back the situation

You’ve written an explanation on a printout so that should cover it as long as you parked up at the first suitable place.

I guess it would depend on what mode the tachograph was set to.
In any case have a look at the printout and see what it’s booked for the time you was away from the vehicle.

If you’re not sure about reading the printout you could scan the printout and mark out any personal information then post it here and we’ll have a look for you :wink:

You will probably be okay, you just missed the bit asking if you wanted a printout or not, and if you say no to that it ejects the card pretty quickly, so it may have already finished off your day and done the end mileage and country. It would have to have done in case you say yes to the printout. Take a printout and see if it shows the end country and mileage and if it does you are okay and won’t need to write any explanation for that.
