I was involved in a serious three-truck crash on Thursday,and the police seized all three vehicles along with the tachos of all three trucks,which were all left in the vehicles at the scene under police instruction.My question is,am I ok to drive under the fifteen calendar day rule with my digicard seized by police as part of an accident investigation rather then it being lost or stolen?The police told me my card will be returned within a week or two,so I’m also wondering where I stand if it isn’t returned within fifteen calendar days.If anyone can clarify any of this for me I’d be most grateful

Yes you can drive without your driver card, the regulations say that you may drive for 15 days “where a driver card is damaged, malfunctions, or is not in the possession of the driver”
My advise would be to phone the police who have your driver card and ask them to email you the name/number of someone who can be contacted to confirm that your driver card is in the hands of the police should you be stopped by VOSA.
I’m not sure if this is really necessary but as a precaution it may also be worth phoning the DVLA on 0300 790 6109 and explaining to them why you don’t have your card, I don’t know for sure but they may be able to give you a reference number so that if you get stopped it can be proved that it’s been reported.
If you haven’t got your driver card back within 15 days I can only suggest that you contact VOSA and ask for advise, it’s not your fault that you don’t have your card so you should be able to continue driving I would have thought.
I hope no-one was too seriously hurt in the accident.

I don’t think the DVLA will issue you a serial number as your card isn’t lost. I imagine you’d need the crime serial number attached to your accident. A simple call to the police force involved should give you this.
Apply for a new card and use the 15 day rule until it arrives. Tell them you have lost your card. When your old card arrives back from old bill decide if you could benefit from 2 cards. If not download the old card and destroy it

I guess it all depends on whether the police had the correct equipment with them although if it was a serious incident then one would assume crach investigation have all that stuff on board.
