Driving time and overspeed

Hi guys I have a couple of questions but I will keep them short and to the point

Firstly, lets say my accumulated driving time is at 4hr and 30mins and I push the button to turn the selection from driving to rest before it hits 4hrs 31mins is this legal ?

Secondly, if i have an overspeed going down hill (lets say 93 kph) for around 65 seconds, is this an offence/infringement does it carry a penalty ?

For 13 years I have been doing local hgv runs and only clocked up two overspeeds in the past five years, 3 weeks ago they wanted me to run a tad further away from home with a heavier wagon, In the last 3 weeks I have got 4 overspeeds on the same down hill section ( ■■■■ idiot i know ) its not as tho I am speeding for any length of time because as soon as the flashing tacho light comes on your reminded of what a ■■■■ you have been and get on the brakes

Yes that is legal, but on a digital tachograph you would be lucky to get away with it because there’s every chance that the driving time will click over to 4:31 even after you’ve stopped and changed the mode to break.

There is some debate about whether or not an over-speed incurs an infringement, but in VOSA’s enforcement policy document an over-speed event only incurs a verbal warning and no fine.

If you adjust the speed within a minute you won’t get an over-speed event.

On good authority from a recent ex vosa TE who is a member on here - overspeeds are only an issue if it happens on regular basis for a long time because that is likely to mean the vehicle does not have the limiter set properly/been tampered with/broken for too long

If going over 60 mph then that would be a police matter not vosa

company policy and overspeeds are a separate matter

Where does this overspeed show up Rog? When I have got into an overspeed situation and then downloaded my card, no such event shows up. I realise that it would show up on the drivers print out but this assumes that no other faults have been noted.

I frequently get an overspeed when running down the M5 between Bristol and Bridgwater.

I have the cruise control on the limiter (88kph) and the speed limiter set at 3kph above that.

The exhaust brake will comfortably regulate the speed to no more than 92/93 kph ( about 57/58 mph) - also confirmed by the sat nav.

My take has always been that as the limiter has not been tampered with and the max. legal speed for my HGV is 60mph on a motorway, then no offence has occurred.

Also, my TM has said that as long as the overspeed is kept below 94kph, he isn’t concerned.
