Driving regulations shifts

Hi i am hoping this is not a daft question but here goes
work for winc leave on sunday to run out @ 9 hrs mon @ 12 hours tue @ 13 hrs wed @13hrs thurs @13 hrs fri run in @1 to 5 hours our transport manager does not regard this as 6 shifts , he regards it as 5 shifts plus sunday overtime so even though digi card in over 6 shifts hes saying its 5

any thoughts appreciated and thanks

Why does it matter what he calls it - the law remains the same re tacho regs

I also don’t understand the question, 5 shifts Monday to Friday plus Sunday overtime is 6 shifts :confused:

As far as the tachograph or working time regulations are concerned it makes no difference what you call it, you can do as many shifts as you like between weekly rest periods as long as you don’t go over 144 hours between weekly rest periods.

Perhaps you could be a bit more explicit about your concerns :wink:

sorry thought this might be a little difficult,try again , is a shift ie put card in and take out as little as 1 minute and up to 15 hrs regarding driving regulations?
our issue is a missmatch between wtd+driving regs+employment law+our t@cs

so as far as i see it 6 days of work no matter how short are 6 shifts in a row not half plus 4 plus half

to rephrhase another way we get paid extra on a 6th shift but our boss is saying half (run out) plus 4 plus half (run in) is not 6

any better?

This has nothing to do with any regulations other than your companies internal rules, as far as I’m aware there is no legal definition of a “shift”, but most people would regard as shift as the time from when you start work to the time you finish work, it doesn’t matter whether it’s 2 hours or 15 hours it’s a shift.

As you appear to get paid by the shift you would have to sort out with your boss what constitutes a shift and what constitutes overtime.
Personally I would say that unless your contract says otherwise a shift is the time from the start to the end of a working day, overtime is usually time added onto a normal shift.

Could be a TM thing , you know the sort , everything fits into a 24hr clock :unamused:
