Hi, can someone help me with my drivers hours ?
I finished for Xmas on the 17th of December and returned to work on Tuesday 4th of jan. I then worked Tuesday, Wednesday, Thursday, Friday and Saturday.
I finished on Saturday at 4pm and started work again at 8-30am on monday and will be in until Friday.
My question is, can I work this Saturday?
I think yes as I’ve only worked 5 days last week but not 100% sure!
Yes you can.
If by the time you resume work after working Saturday you have had less than 45 hours weekly rest that is still okay, you had a full weekly rest last week at the start of the week, just make sure you have a full weekly rest next week.
Incidentally how many days you work in the week isn’t the defining factor in this sort of situation. You can work 6 days in consecutive weeks, and for several weeks in a row, as long as in any two consecutive weeks you have at least one full and one reduced weekly rest period, and make up any compensation required within the time limit.

You must start a new weekly rest period no later than six 24 hour periods (144 hours) from the end of the last weekly rest period.

A regular weekly rest period is 45 consecutive hours but this may be reduced to no less than 24 hours (compensation needs to be paid back for the reduction).

In any two consecutive weeks you must have either two 45 hour regular weekly rest periods, or one regular 45 hour weekly rest period and one reduced weekly rest period.
In other words you must have a weekly rest period every week, this can be either a regular 45 hour weekly rest period or a reduced weekly rest period, but you must have at least one regular 45 hour weekly rest period every other week in which case you would also need a reduced weekly rest period every alternate week.

However, if you are having Sunday and Monday off then yes you can work the Sunday of next week, then you will require a weekly rest of at least 24 hours.
If you are starting again on Monday after 45 hours off you may or may not be able to work Sunday. You must begin a weekly rest no later than 144 hours after resuming work following your last weekly rest. So, for example, if you resumed work at 12:00 Monday you could work Sunday morning up until 12:00, start at 14:00 Monday and you are okay until 14:00 Sunday.

Presumably you will be starting a weekly rest period before midnight on that last Sunday in which case you should be all-right.

And does that mean you will be taking 45 hours rest and resuming around 10:00 Monday?
If so that means you could only work on Sunday until around 10:00.

Hahahaha I got there in the end!
The reasons I ask, is I’m a concrete mixer driver. Up until last month I was doing 8am to 4pm, 5 days a week. It was pretty easy to stay legal.
Then we started doing loads to a new job which want concrete at all hours and at weekends! As I’m self employed I want to do as many loads as possible but also stay legal.
