Hope somebody can clear this up for with truth and fact.
I have been told if you have a driving assesment fas part of an interview you can do it without using a tacho as your not being paid for that time and it is not classed as work, reason said was so you can freely attend an interview without current employer knowing plus it wont interfere with your daily/weekly rest periods.
I was under the impression that you had to tacho up and take it on the chin,
Can anyone clear this up by fact and if at all possible supply a link from a legit source,

Nope, you most definitely need to use a tacho if it’s a tacho equipped vehicle.
I can see where you’re coming from with the not being paid for it bit, but it would still be illegal not to use one, and I imagine the assessor would be unimpressed if you didn’t.
If he says you don’t need one you’d need to question if it really was the sort of company you’d want to work for anyway.

I thought you did, we were talking about it in the yard this morning, 1 of the guys was adamant (not the 80’s popstar) that you didnt need to.
I’ll make this really simple for your colleague who doesn’t think you need to use a tacho or that an ‘assessment drive’ doesn’t come within drivers’ hours rules.
There is no exemption from EU rules that cover this activity.
Failing to use a record (digital or analogue) will, if caught, result in a Prohibition Notice for the appropriate daily / weekly rest period and a Fixed Penalty Notice to the value of £ 200. You can go and argue the point in court if you wish but the maximum fine will be up to £ 2500.

I had a driving assessment with Walkers crisps a couple of years ago and didn’t use the tacho, the assessor said because it was classed as training, which made sense at the time because you don’t have to use the tacho when learning, even though the vehicle is equipped with one, but every other assessment I’ve had since I’ve always had to use the tacho.
It would be interesting to see a link on this.
Two weeks back a mate mislaid his card for one day - he treated this as for a malfunctioning card and took start of day and end of day printouts - signed and annotated as a manual record.
Any reason why you should not do this for an assessment?
