Driver under EU and Door Work on a night?

One of our lads can’t come out on the bender we have planned for tonight as he is working the door… I said what are you on about and it turns out he works as a self employed bouncer on a Thur, Fri and Sat night - I said you know this screws up your weekly rests don’t ya - I won’t tell you what he told me… but what do i do now?

If I know and dont do something then what happens - could VOSA find out?.. if i say anything in the office and make it formal then knowning dad he will threaten to sack him and what if he continues anyway.

He is a good bloke, just had a kid, but can I just ignore it and turn a blind eye but then will i then be expected to turn a blind eye to other things ?

Its our family buisness - so I aint being a grass because I am an egit.

This one - I just wish I had never organised the bender - then i would not know - even if he finishes at 3am, he can only get a 25 hour weekly rest in which is ok some weeks but not every week - he cannot legally work for us on a Friday until 10am in the morn - which is way to late - I can try and help out and schdule a late load on a Monday - but then that is favouritism, and unless he agrees to not do door work every week it will only go so far to help.

If he was a punter at these places then you could not do anything about it

unbeliveable totally unbeliveable ffs, was your family business built on the founder working limited hours a week , i very much doubt so, jesus what real concern is it too you, its not as though he is moonlighting driving for another firm

be a different story if he was out on the pish till all hours those days, but as it is i don’t really see a problem with it. give the lad a pay rise then maybe he won’t need to supplement his income in this way :smiley:

Trust me if i could get the lads and me a pay rise I would !

11. An employer of a mobile worker shall

(a)request from each mobile worker details of any time worked by that worker for another employer;
(b)include time worked for another employer in the calculation of the mobile worker’s working time;
(c)keep records which are adequate to show whether the requirements of these Regulations are being complied with in the case of each mobile worker employed by him to whom they apply;
(d)retain such records for at least two years after the end of the period covered by those records;
(e)provide, at the request of a mobile worker, a copy of the record of hours worked by that worker;
(f)provide to an enforcement officer copies of such records relating to mobile workers as the officer may require;
(g)provide to a mobile worker or enforcement officer copies of such documentary evidence in the employer’s possession as may be requested by the worker or officer in relation to records provided to him in accordance with paragraph (e) or (f) above.

you can draw up a form and give it to all your drivers to fill in

if he does not fill in the form have him sign it to say he as not work for some one else this may cove your firm if asked by Vosa

Thanks delboy - that could be an idea.

Delboy has the right answer. Issue ALL drivers with written information regarding their responsibilites to report other work in writing.

Ask them to sign a declaration (maybe every three months when doing licence checks) - I can send you such a declaration I have used before if you want. This then passes the ‘buck’ to the driver.

Of course I would interview this particular driver and tell him he can’t do what he is doing and why. I would have someone take the minutes of this meeting and file them away. Not a disciplnary meeting - just a chat on record.

To those who think this is over the top - it is simply protecting the Opertor Licence. Any action against the licence could affect all drivers - not just this one. Protect the licence at all costs.
