Just been told I need 30 mins break before 6 hours worked…can somebody please tell him

sorry, can’t help. i’m not doing the dcpc.
but i might print off a few hundred driver trainer comments for my first dcpc court case.

I can normally squeeze a quick 30 min break in on pumps, but only if I’m quick. :wink:

Do you get paid for your break time? If so, take 30 minutes, simples. :slight_smile:

You can take it in 2 equal parts, but the second part must be at least 15 minutes… :laughing: :laughing:

We take 30 mins too. We know its 15 and so do the company but they would like us to take 30mins so everyones a winner :smiley:

Winding Up Fines

Its interesting how different companies allow different ways of taking breaks under WTD. We have 50+ agency a day and its amazing how many of them come back and argue with the transport office when they are questioned over too many breaks in a shift. Majority do not realise or dont want to know that breaks can satisfy both EU hours and WTD at the same time. We encourage our own drivers to take 30 mins in the first 6 hours and 30 in the second (continuously watching out for the 4.5 hour drive too). Yes it may be extravigant but compliance is a big issue for any company.

4.31 drive may only be just one minute but it is still an infringement, no blaming the old two minute rule for causing it, I am sure we are all well aware it could happen with the digi and click over , but why push it to 4.29 all the time.

As for WTD breaks the law I think reads ’ If you work more than six hours but no more than 9 you must interupt this time with at least 30 mins’. So 15 before 6 hours and another before 8.59. will satisfy this.

I can see VOSA trying to manopolise on the WTD breaks soon especially after the money the make on Graduated fixed penalties. I am so surprised it does not attract GFP yet.

Yes but not enough to comply with the working time regulations which requires a total of 30 minutes break if your working time is more than 6 hours but not more than 9 hours.

To comply with the RT(WT)R they would need to have another 15 minute break then do at-least 1 minutes other work before finishing the shift.

Tachograph has it spot on you cannot comply by ending your period of working time by starting a daily rest period because you have not satisfied the regs by failing to interupt your working time with atleast 30 minutes break.
You would only qualify if you never actually worked more than 6 hours before starting a daily or weekly rest period.
Sorry tachograph I probably said exactly the same as you but a bit long winded.
