Double Manned question

Please tell me if this is legal or not.

Driver A starts at 3pm for a double run (2 trailers worth) - Does one drop comes back to depot do second run at 10pm. Gets told that Driver B is helping out and jumps into the cab for the remaining of Drivers A 12hr shift (he started at 8pm) - not inserting tacho card into slot B (yes he is a driver and already did a run prior) and gets told by office bods to do manual enteries on return.

Personally I don’t believe it is

Who gets done should DVSA do a midnight check?

A double man must be in the vehicle with you within a hour of you starting to count as a double manned route,otherwise he is just a spare man and you still only have 15hrs from the time you started.

No,what you’re doing or been asked to do is perfectly legal,although not quite sure why your 2nd man just doesn’t put his tacho in anyway.

My thoughts too on not inserting his card (but thats his problem)

My understanding was that 2 drivers must start within the hour of each other - but there is a 5hr gap in this case thats got me thinking if its right or not.

If your staying within 15hrs it’s ok,over 15hrs the 1hr rule would apply.

I assume driver B never did any driving on the second run ?

Technically he should have put his card into slot 2 and it is an offence not to do so, though if he did a manual entry on return to base I doubt anyone would be too bothered.

I also can’t see why driver B would not put his card in slot 2, it only takes a couple of minutes including a manual entry for any missing time since he ejected the card after his first run.

The two drivers only have to start within an hour if they intend to take advantage of the daily rest concession for multi-manning, in this case that doesn’t apply.
