As far as I know, you can put it on rest and it will count as a break, if you leave it on work, then it will count as you are working.
Maybe im wrong, no quite sure.
HI.If you’re working you leave it on other work and for a break you must switch it over or it will not record your break.Hope this helps.
leave it on break, the automatic mode will switch it to other work, there is no driving mode and hasn’t been for about 20 years.
As long as you put a bit of other work in when you are stationary, that will keep Bev happy.
If you leave it on other work all day, it will not record any breaks, even if you have an hour for dinner

When you say “rest” I assume you mean when you have a break ?
When you have a break that you want to count for the regulations you must put the tachograph mode onto Break/Rest (bed Symbol)
The correct way to do it is to leave the tachograph mode on “Other Work” (cross hammers) when you are working and it will automatically change to drive mode when the vehicle moves, then when you have a break you should change the mode switch to Break/Rest for the duration of your break (<<< very important).
It’s very important that you remember to change the mode switch to rest when you have a break otherwise you will be getting infringements for not having the correct breaks.
At the end of the shift take the chart out.
okay seems clear ,as aid from now on ill set it to break after install of fresh chart and all is well.
as you have to keep the last 28 days of charts with you ,if i get pulled and explain that im brain dead and didnt switch to break/rest ,but can show by the charts i took the correct breaks ,but on the wrong mode ,am i still in the ■■■ and can you get points for tacho infringments…thanks tony .

Well it’s obviously not that clear
It’s illegal to have the tachograph on break whilst working and would probably be regarded as more serious than not showing any breaks on your charts if you get caught.
You should get into the habit of putting the tachograph on “Other Work” and only changing it to break for the time you are on break.

If your charts do not show any break then I’m afraid that you cannot show by the charts that you had the correct breaks, so yes you will be in the [zb] if you get stopped and show the charts.
You could do manual entries on the charts but to be honest I don’t know how VOSA would react to every chart having the same manual entries on them
Hasn’t your employer ever pulled you up over this ?
I would advise you to have a good read of the Rules on Drivers Hours and Tachographs whilst you still have LGV entitlement

If you mean points on your license then no you won’t get points on your license for tachograph infringements, but you could lose your entitlement to drive LGVs for a while if you get caught and it can be shown that you perpetually fail to comply with the regulations, hence my advise to have a good read of the drivers hours and tachograph rules

tachograph has explained what you need to do in order that you keep yourself legal.
If you fail to follow his advice, you won’t get points on your licence, but you may have to pay a fixed-penalty fine, or explain yourself to a Traffic Commissioner like this member: Called before the Traffic Commissioner - SAFETY, LAW AND WORKING TIME DIRECTIVE FORUM (INTE - Trucknet UK
In your case and from the info you’ve given, it could be that you’re creating a false record for which the maximum penalty is a £5,000 fine or a couple of years as a guest of the Queen. It’s fair to say that you probably wouldn’t get such a punishment for a first offence, but please be aware that creating a false record is a very serious matter and is easily detected.
There is also a lesser offence of failing to operate the mode switch, but would you really want to take a gamble on which offence they’ll nail you with once you’re pulled over at the roadside??

About 5 times isn’t as bad as I thought from reading your first post, doing manual entries on the charts seems like the best solution.
Your employer has to keep the charts for 12 months or 2 years if they’re being used for WTD purposes.
If VOSA were to go to the office and inspect the charts I believe they could go back 6 months for tachograph offences.
Having said that you have to ask what’s the chances of your employer being asked to provide all records for inspection, unless your employer has had problems in the past I’d say the chances are very slim
