Digital tachograph rules, urgent help please

It could be that another person has found your card and thrown it away … how do you know that has not happened ?

What “Rog” is trying to tell you is:

Its a simular situation to that of Forgetting to mount/fix your numberplate to the rear of the trailer.

If you admit you forgot to afix/place/display it there

( its probible Mr Vosa, will ask you to fetch it, and place it were it ment to be )

expect to get a penity ticket of failing to display it…

If you say it was there, and is now missing: He will MOST certantly issue you with two penity notices:

1: For having an insecure load ( yes, because you cant prove it didnt fall off )

2: And other for failing to display the number-plate.

Now Driving WIthout Driver-Card & Hence the records it contains

Mr Vosa dude, is only going to be happy if your driving for reward without your card:

Truthfully & to the best of my knoledge:

The ONLY REASONS are:

i: its been returned to DVLA [ Damaged / Faulty ] And you are awaiting the replacement.

ii: Its [ Lost / reported Stolen ] And you are awaiting the replacement.

i.e you have APPLIED for a REPLACEMENT ( OK )

If you have NEVER been issued a Digi-(tacho)-Drivers Card , or your card has expired,
you can NOT legally drive a vehicle fitted with a Digi-Tacho

Same applies if you admit to mislaying the card see “Big eck”'s follow-up post.

How-ever
if you have Applied for a replacement because it [lost|damaged|malfunctioning]
you can continue to drive for upto 15 days, during which you must provide printouts.

Without either the Card or such records in your procession

Thou the VOSA officer may have a sence of humor, he might chuckle at your miss’es sitting on the card
The cat eating the printouts, or the fact they blow out of the Cab window, etc.

Mr Vosa with a smile will:
Because as you are now unable to produce the records “Mr Vosa” requires

proceed to issue you a months worth of penity tickets.

one for each of the 28 days of records your unable to produce !.

With the co-operation of your employer, assuming the data on your card has been downloaded reguarly
you might be able to provide records for maybe the 1st fortnight. if your very lucky, maybe 3 weeks.
But that will still leave you with a nasty fine

And if you cant with the assitance of your employer prove that you had adicate dayly &/or weekly rest
get a double nasty suprise, as you & your vehicle become residents of the check-point.

Perhaps the people who are saying it’s generally OK to drive while the driver card is not in your possession and is not lost or stolen, could explain why if you get stopped by VOSA you could be parked up and fined £200 for failing to produce the required records ?

while your waiting for the replacement for your:

" [ LOST| STOLEN DAMAGED | MALFUNCTIONING ]" card to arrive

you got 15 days during which you can drive for reward. ( see form D777B )

I Suugest: ( cover your assets, there dangling just waiting to get kicked, as follows )

AT START of SHIFT
Do a printout ( just incase the wagon been moved since you last drove it )

Write on the back: " Vehicle Movements by OTHER DRIVER "

and sign it on the face in space provided at bottom

AT END of SHIFT
Do a 24hr printout, write on the back, why your driving without a card

(only valid reason = " Driver-Card returned to DVLA, Waiting for Replacement " )

then sign the printout at the bottom on the face-side in the space provided.

IF you losse the card during your shift: Do a Printout IMMEDIATELY from the Wagon you were driving.

Keep a manual record on the rear of this printout detailing the remainder of the shift
i.e time spent "Driving " “other work” " rest period " " POA " etc
in the graph/area on the back of the chart ( just as you would on a paper-tacho )

and in the remaining rear side space:
" Driver card lost/stolen/damaged etc, today around [time]UTC, while away from vehicle "
" intend to apply for replacement if not found by end of shift " etc !

And sign it, at the bottom, on face-side

Assuming your driving same wagon, or another digi-wagon
At the end of Shift, Do another printout, sign it, attach it to this one (ok)


Manual Records

Personally I like to keep manual records using the space provided on the rear of
an old-stile tacho-disk to which I then attach the digi-printouts !!

how-ever if you do this, dont forget to fill out the required fields on the face side…

MOST IMPORTANT

RETAIN ALL of THESE in SAFE PLACE ( Pref with YOU at ALL TIMES, in your day-bag etc).
lossing or damaging these flimsy bits of paper will place you back at square one,
ie dealing with a months worth of penity notices, and fines that will make you eyes pop out
and if your very lucky, becoming yet again a resident at the Vosa Check-Point :confused: (OK)

If said " lost " card is latter found ( i.e after you have applied for a replacement )

Keep it safe, and inform DVLA …if you must
But above ALL DONT USE IT ( better still, cut it in half & retain it )
because there are now two-cards with your unique driver-ID but with differing issue-numbers
God forbid If you or someone else uses it ( place it beyond your’s or there use, Burn the bl**dy thing )
Otherwise youve just placed yourself in line of fire for comiting a whole bunch of other offenses !

PPS: Paying £19 quid to obtain a replacement is BY far the cheapest option…

PPPS: I presently have just returned to DVLA my Malfunctioning Driver-Card
( bring back Wax Tacho-disk’s, life was much easier in the " Good Old Days " :laughing:

Just a quick update folks.

I now have my card back as of Thursday last week lol

I also phoned VOSA direct and asked there advice and was told that under no circumstances was I allowed to drive any kind of vehicle with a tacho (digi or otherwise) as the card was not lost/stolen or damaged. As it was left in the van by myself and was entirely my own fault.

So be warned.

I’m not prepared to put my licence on the line for anyone no matter what job I was in. Would you be prepared to pay the fine for one of your drivers if they were caught■■? I don’t think so.

and you be in trouble with vosa and an employment tribunal, whats the point of having a digital driver card if it ok to drive without it rules are rules. and i would not want to work for a company that would think there have the right to risk my licence. :smiling_imp: :imp:
