Digi card query

my digi card stopped working on thursday 26 oct (tacho showing " driving without card") so on road home i called in at local post office for a form for a replacement. they didnt have such a thing and suggested i ring dvla for advice (08440961830).the guy on the other end was very helpful and said it could probably be dealt with over the phone,however when i gave him my address it became apparent i had failed to notify change of address and would need to download the relevant form for the digi card d77b and obtain a d1 form from post office to change adress on my licence too, and post with a covering note.so far so good.i understand i can drive using a vehicle print out from beginning of shift and another from end of shift to log my hours for up to 14 days?? .however as i have in the past suffered from sleep apnea which dvla were aware of (it is now under control) they are doing medical checks, fair enough!.the problem i have is the 14 days are up and still no digi card . can i use a vehicle with a analogue tacho until i get notification ■■? or am i expected to pack my job in■■? i`m rather confused and more than a little worried ,i did intend to ring and enquire but due to a number of different reasons i never got round to it. any opinions/ advice gratefully accepted. :confused:

I believe you should be ok driving analogue only but keep the faulty card with you.

You cannot legally drive after 15 days, I suggest you get round to phoning the DVLA on 0300 790 6109 pretty quick.

I thought it was only digis that affected and not analogue ?

Was your licence returned with your new address? Also what do you mean when you say…“they are doing medical checks” ? How did they convey or word this to you? I’ve a feeling you’ve a bigger problem than being delayed for your digi card ?

Clarification anyone? I thought the same as ROG (obviously use of analogue tachos would not be affected by a faulty digicard), unless legally you MUST have a WORKING digicard on you, if you have ever had one issued.

a number of years ago i was dignosed with sleep apnea and informed dvla accordingly.they enquired at the clinic where i was being treated who gave me the all clear ie it was under control.dvla sent me written confirmation that they were satisfied i was fit to drive, and i carried on as normal. i can only assume that it has "flagged up " on the computer when my application for replacement documents went in. i used to go for a review annually but it was decided i was responding ok to my treatment and i was simply to contact the clinic if i had any problems (i havent). so it was a bit unexpected and unnerving when the medical checks were mentioned.i had actually put “my problem” to the back of my mind as my way of dealing with it.it is now just an every day part of life that i simply accept as “normal”. ps sleep apnea is much more common than you would imagine , i know of at least 4 other people in the same situation,two of whom are also drivers .the “cure” is quite a simple one but very effective, i couldnt believe the benefits.i only became aware of the problem when my wife at the time complained that not only was my snoring getting worse , i sometimes stopped breathing whilst asleep .

I haven’t yet found the answer to this in any regulations but the application form for a driver card says that you can drive for 15 days without a driver card, I would tend to assume that it also applies when the card is faulty because legally you have to be able to present the card for download at the road-side if requested to do so.

I would not like to put my neck out and say that you must have a working card or no card after the 15 days, but I would guess that you would need a working card.

Very keen adherence to rules, but technically correct! I’m beginning to think that to follow the letter of the law, you must have a working digicard on you, if you have ever had one issued.

If you need to use the card and find it to be faulty you have 7 days to report it and 15 days to get a new card.

If you get stopped whilst using an analogue tachograph and VOSA want to check your card there shouldn’t be any problem if it’s found to be faulty, especially if you’re using an analogue tachograph on a regular basis and could produce the required charts.
If the card was checked and found to be faulty you would have 7 days to report it and 15 days to get a new card.

In the OPs case the card has been reported as faulty which is a different situation altogether.

Happened to me, mine was in my wallet from when I got it till the day came to use it, put it in for the first time and it did not work followed TM words of wisdom and phoned DVLA to report it, did printouts for the few days as told to at start and end of shift got new card back in 5 days and all ok since I now use a cover for it, and its never gone that way since, just to note the only reason the TM new what to do is because he took a days training on it when there ordered the software which shows you that some TM,s will lean new things :stuck_out_tongue:

I am inclined to agree with tachograph. The card has not expired and has been reported as faulty, the driver therefore has 15 calendar days. I am sure he could speak with VOSA and get some kind of dispensation but there again … maybe not.

If the card had expired - no problem, just stick to analogue, but if there is a valid card ‘somewhere’ you only have the 15 days. if he was subject to a roadside check they would know a vlaid card existed and could check (I’m sure) it had been reported - therefore would know when.

However - as per someone elses post - I think there’s possibly a bigger problem than the digi card if the new licence hasn’t been received yet.

licence came back in thursdays post (new style) and digi card arrived yesterday :smiley: :smiley:
