a driver passed cat C before the deadline and has grandfather rights
he then passed cat C+E after the deadline
can he drive without DCPC on both categories?

The dcpc relates to all LGV (and PCV) categories no matter what categories they are
i know that Rog but when he only drove class 2 there was no question of whether or not he needed DCPC. he didnt just like you or me but now that he has passed class 1 AFTER sept 2009 i am really not sure whether his grandfather rights extend to the new category

He can drive any category of LGV vehicle until September 2014.
The DCPC is not category specific, grandfather rights for a cat C vehicle covers him for any LGV category
A lot of people have DCPC grandfather rights for any LGV vehicle simply because they passed the car driving test before 1997, and so automatically have cat C1 on their licence.
thanks very much. he is struggling to get an answer on this. DVLA and VOSA say he can drive artics but DSA say he cant. agency says yes, client says no. drivers are no use as we tend to know only the regulations that apply to us individually ie i passed before the deadline so i know i have until next september. thats all i need to know which is just human nature

Scanny77,
Both you and the driver have grandfather rights = neither of you need an initial DCPC.
Both you and the driver need 35hrs of periodic DCPC, which must be completed before Sept 10 next year.
The fact that the driver upgraded his licence to C+E has no effect on his situation, exactly as mentioned by tachograph and ROG.
