Maybe, but the point is that in rail accidents (which this was classed as), subsequent enquiries have always looked as system improvements rather than just blaming the driver. It should not have been mechanically possible for the tram to enter the curve at such an excessive speed.

Tube trains cannot impact buffers because of a system known as “Moorgate control” which was introduced after the Moorgate tube crash in 1975 for example. The technology exists to do all of this stuff.
