Cpc ,some questions

1.ive never used p.o.a but trainer told me id be in serious trouble,fines if i get stopped by vosa, and arnt showing p.o.a on my tacho,i use rest,break and other work,never had a infringement for not using it but this trainer says i must start using it,is he right ,why.
2 he also said there is a rule where if you dont start work[i.e sit in canteen for 9 hrs waiting for a truck],you then have to have a 45 min break before leaving yard,again is that right.
3 now been told i am to run at all times with midlift down,the reason being its cheaper to pay for new tyres than cost of a bridge strike[there thinking is it lifts back of unit/tri up 3 inches with midlift up and i /drivers may forget and hit bridge],surely its my decision when to have midlift up/down,id hope ive/other drivers have enough about them to remember when its up/down]
4. ive been told if i get stopped by vosa ,my first question should be are youACTIVELY TARGETTING ME,second is are you TARGETTING ME UNDER OPERATION VIPER,isnt all this a bit confrentational,ive not been stopped for years,i try to avoid if possible,but wouldnt MORNING MATE,followed by a smile,make more sense
i would of gone into it a bit more in depth myself,but apparently if you dont agree he just sends you home

  1. If it qualifies for POA, it qualifies for Rest.

  2. If I was sat in a canteen for 9 hours waiting for a truck I would be on my way home before I had 45m.

  3. Although it is your choice, if the company & company policy want you run with the mid-lift down, then do it, before they disconnect the switch. I imagine Stobart have enough grassing drivers and the weird brigade of spotters will shop you, even if a senior manager doesn’t spot you.

  4. I would just say Hello and wait for him to ask me a question or inform me why he has stopped me. I would probably ask if it was a targeted campaign and could I have a window sticker to show I have already been stopped that day.

No you don’t legally have to use POA and I suspect most drivers don’t :wink:

On the other hand if it’s company policy to use POA when it can legally be used that’s a different story, but you certainly won’t be in trouble with VOSA for not using it.

I’m warming to your trainer but only because he amuses me :laughing:

If you sit in the canteen for 9 hours on POA you don’t need any breaks, on the other hand if you sit there and book it as other work you should have at least 30 minutes break during the shift (not at the end of the shift) or 45 minutes if the working time goes over 9 hours (again not at the end of the shift), 15 minutes of that break should be taken before exceeding 6 hours working time.

Your employers do have the right to tell you to keep the rubber on the road even if it does seem a bit over the top.

If I was a VOSA bod and a driver met me with the words “ARE YOU ACTIVELY TARGETING ME”, unless he was laughing while he said it my first response would probably be to wonder what you had to hide :unamused:

He’s saying you’ll need to have Your required break for you WTD more BS! Because your on POA for nine hours and only have a possible 6 hours to the end of your shift!

If all that came from the CPC trainer then he needs a proper slapping. He’s wrong on all 4 points for reasons other have already explained.

i would treat the training as i treat everything else…nod my head at the correct times say yes a lot then carry on as i please.
