CP Plus... here we go again

Every week, when I get home, I have one of these waiting on the doormat, sometimes two, occasionally three.

And every time, we go through the same old song and dance routine.

  1. I appeal to CP Plus on the grounds that the amount claimed is not a genuine pre-estimate of loss.

  2. CP Plus reject my appeal but send me the POPLA appeal code.

  3. I appeal to POPLA on the grounds that the amount claimed is not a genuine pre-estimate of loss.

  4. CP Plus pay £32 for the POPLA appeal and somebody from CP Plus spends hours putting together their claim pack.

  5. POPLA uphold the appeal.

Are these glorified cowboy car clampers ever going to get it into their thick heads that their operation is illegal?

Think their will be plenty not paying, who don’t work for spineless bosses who will just take the “fine” out of the drivers wages.

Do tell us more about this none payment at services Harry… Seems that a lot of places are using outside firms with the number plate recognition to try and screw people, not just at services but they’ve started it at some supermarkets locally…

Good on ya Harry, but as you can guess there’s so many who do pay that they can swallow the odd losses.

Very good question.

Yes, not paying the £18-£22 Parking fee is virtually theft. You obtained a service without paying

BUT…

The £100 that CP Plus are scamming off motorists is another matter.

CP Plus can only claim losses, now as they are not the landowner, they haven’t made any.

So I agree with not paying CP Plus, but the MSA’s /Truckstops etc. should be paid the parking cost. Otherwise go and live in a layby like the others who cant afford parking.

The point is that if you are late paying the bill, I won’t send you an invoice for five times the original amount and dress it up as a fine.

It’s not illegal though.

Anyone can invoice another person for money, the difference is as you’ve shown is they have no legal standing when it comes to actually obtaining the money so they can’t force you to pay it. Taking you to court will cost them and 99.9% of the time fail because they can’t prove they are at a loss from you not paying.

Than you. Two points I’ll make here.

Firstly, as well as the £700 a year road tax, I pay around £8,000 a year in VAT and £30,000 a year in fuel duty. As far as I’m concerned, I’ve paid more than enough tax to entitle me to park for the night when the law requires me to do.

Secondly, private parking companies operate a highly questionable business model which relies on intimidation to extort money from motorists which bears no relation to any expense they incur. In this, the AA, RAC and numerous consumer groups agree.

CP Plus are not the Police, and they are not local authorities. They cannot issue fines, yet this is what they attempt to do. I have appealed well over a dozen of these speculative invoices on the grounds that the amount claimed does not represent a genuine pre-estimate of loss, and POPLA, the Parking on Private Land Appeals service has upheld each and every appeal.

Despite the fact that CP Plus have been told on numerous occasions by POPLA that their claims are unreasonable and unjustifiable, they continue to issue these “fines” safe in the knowledge that the majority of motorists will be frightened and intimidated into paying them. They are bullies, I am the little man fighting back, and that’s what I will continue to do.

I will update this thread as the case progresses, but will gladly answer any other points raised about the morality and legality of my actions.
